    I would say Canada because British Columbia has a much higher standard of living than Boston. Canada is generally a much better place for raising kids and the stress levels are lower because of freebies like health care etc. BC also has a much better weather compared to Boston.
    The other reason is that you could always come to the USA from Canada later but if you lose the Canadian PR now and don't manage to get a green card in the US, you lose everything.

    Hi All,

    I would really appreciate everyone's honest opinions on this matter.

    We filed 140 and 485 concurrently in July 2007, EB3. As of now there is no word on either application. Previously we had also obtained Canadian PR, the 3 year grace period of which will expire this August.

    Not only am I faced with a decision of staying in the US or going to Canada, but my future career is on the line too. This year I will be 23. After taking my undergrad degree in electrical engineering, I have been accepted into Boston University Law School in the US as well as the University of British Columbia Faculty of Law in Canada. Canadian lawyers make around half as much as American ones after all factors are considered.

    In your opinion, should I stay in the US, going to law school, in hopes that the green card will come through, or should I pursue a new life in Canada, but take the lower future salary / international renown?

    This issue is currently causing much discord in my family. I hope to hear your frank opinion so that I won't take my decision lightly.

    1) Degrees from non-accredited colleges cannot be used for any immigration purpose (or for any other purpose for that matter)

    2) A Post Graduate diploma is not enough for EB 2. You will need to do a Masters from a accredited US University. Remember, many online universities (including Phoenix) are accredited too.

    So you got the receipts without the checks getting enchased? Ddid any one who were sent to CSC did not get their checks enchased but recieved receipts?

    got my receipts from CSC, filed at NSC, details in signature
    checks not yet cashed, no receipt for 131.

    Can you please help me with this?...I have already submitted the affidavit copy and now they want it from Registrar office. Has any one got it from registrar office in India? if so, how difficult it is and what is the procedure?

    "A photocopy of a birth certificate issued by the Local Registrar if the person named above was born in a city, or

    A photocopy of a birth certificate issued by the Additional District Registrar�s office if the person named above was born in a village.

    If a birth certificate does not list the names of both mother and father, or the child, secondary evidence must be submitted to establish parentage. Secondary evidence includes, but is not limited to , copies of: medical records, school records, census records, government-issues identity cards, religious records and/or affidavits from at least TWO persons alive at the time of birth. The oldest available evidence that lists the names of both parents should be submitted."

    Yes, you'll have to get it registered.

    It is not big deal. Just ask your parents to get in touch with a document writer (guys who'll be sitting in front of Registrar offices) and they'll do it for you. Your mom and dad may need to go and sign the docs in front of the registrar.

    Ok, let us be united. Let us work on getting USCIS to follow the letter of the law. What is it you ask? It is that the Visas be spilled over as required by the law. It is nothing to do against EB3 or EB2. The visa spillover suggests that the overflowing visas be issued to the most critically retrogressed queue (upon satisfaction of per country limits). Does it help Eb3 or EB2? Both, whenever there is a longer queue, that line is able to move forward.

    Right now it is EB3 which is reeling under the incorrect implementation, and EB3s want to see it rectified, while the EB2ers demand Unity (knowing well that they stand to lose -- what was never theirs), I would not be surprised that EB2 raise the loudest voice of action (and no talks about unity) had the tables been turned.

    So you see why I think the message of unity sounds so hollow.

    Well hollow or shallow does it help you?

    hmhmh =------- NO!

    Stop questioning EB2 or EB3, they both represent EB community. Yes you maybe right about people thinking about EB2 faster thatn EB3,

    But have you followed the bulletin lately?

    And the ways things are going, do you really think EB 2 will clear fast and then EB3 will gain a faster movement?

    Golden Answer? NO

    Whether you like it or not, we need each other, the impact is always greater when the intensity applied to it is greater.


    You can keep thinking about how hollow you and I are, but the fact is we both need each other. Everyone see's us as EB community, not as EB2 or EB3,

    Most of those Morons don't even understand the difference between H1b and green cards,


    So get yourself to think EB community as a whole, not EB2 or EB3, or who benefits first?

    isn't ability to pay normally satisfied directly via paystubs and W2 when you have worked for the company. esp if company has already paid you for the period of say 1 yr then ability to pay is proven no?

    Hello friends,

    Of late everybody is talking about bad economy. I mean its all over the TV and newspapers. Apparently we are in a recession since past one year (since Dec 2007).

    However, odd it may though sound, I don't see any real economic slowdown in IT sector. I mean all my friends and acquaintances in IT industry in the US and India are retaining their jobs. I recently talked to my IT recruiter and she told me that as far as she is concerned this year has been like any other years. Bit sluggish at the year end, but loads of requirements lined up for January next year.

    Am I the only one who is feeling this way, or others also sensing the same thing. Maybe the real jolts are still lying in the future, in the coming year. Or may be its just a hoax. I would love to know other people's observation on this strange anomaly between what is being reported in the media, and what is being observed on the ground.

    Sargon please update your profile with correct information instead of faking as EB1 from a ROW country stuck since 2003.

    The realistic answer is no. It is almost impossible to get eb2 in software jobs. On an average it is taking more 9 months to get labor clearence that too if it is eb3. if you are trying eb2 that is almost a definite audit. We have a case in our company which was stuck in audit (eb2) for more than an year now. our company and attorney have a policy that they are no longer filing eb2 (offcourse it is a different matter than they are no longer filing any green card application because of layoffs). So unless you are working for a desi "con"sultant company not many american companies (almosy none) are filing eb3 green card perm applications leave alone eb3 to eb2 conversions. Even desi companies are scared shit because USCIS is knocking the living daylights out of them. Even desi companies are scared of filing eb3 green card perm applications leave alone eb2.

    we are living in a different age now where there are reports that USCIS is sending out invistigators to look into even ac21 cases. Enforcement has gone up, hint :last year h1 got filled on day 1, we are almost 6 months since h1 opened and only 45k h1 have been filled, the reason is USCIS is giving all sorts of rfe, so nobody is filing for h1. Forget about porting as in this environment you will not even find somebody doing eb3, only day dreamers will think of some company willing to file eb2 in software.

    My wife has more than 5 years of US experience and we cant even get her employer to file Eb3 because they are saying they are getting tons of resumes in response to advertisement and they dont want to do any green cards for atleast an year.

    As slim a chance as it is, visa recapture or some administrative fix like a temporary green card or relaxation of ac21 regulations like same semilar job restrictions is our best bet.


    Hi All,

    I am on H1B from 1998, 12th year and counting.

    I applied for my labour 2 times but unfortunately because of different reasons those labor processings could not continue. 3rd time I could use a substitute labor (priority date Oct 2003) which is an EB3 labor certificate in 2005. I applied for I-140 and got approved in 2005.

    I applied for I-485 in July 2007 when USCIS opened the gates. My 485 is pending. I got EAD. I am still continuing my H1B status with my new employer.

    I am not working for the company that processed my GC. Recently I got an RFE like everyone else about my current employment and responded with the support of my current employer.

    I think that the dates for EB3 will not move any further in any near future.
    My question is, can I in any way convert my case from EB3 to EB2. If yes, what would be the process.

    Please advice.

    hopefulgc, count me in. I am EB2 India with PD Oct 2004. But as I have mentioned before lots of my friends and family members are in EB3. You have my unconditional support.

    Had applied on July 19th , receipt date of July 20th.
    I never received any receipt notice and today I received transfer notice
    WAC....
    Receipt date Sep 14th 2007
    Notice Date Sep 17th 2007.

    Does it mean I lost the original receipt date of July 20th which should have been ideally my receipt date.

    It takes about 2 weeks get the RFE. It contains 2+ pages, first page is cover letter and second page+ will contain RFE details. NSC is know to issuing RFE on ability to pay, education (if 3 years degree) and detailed professional experience letters.

    Following intresting info is listed on the immigration-law, wish it is true :)

    "There has been going around a rumor lately that the USCIS was internally discussing retreat from the 485 rejection decision. It appears that this rumor probably started from the USCIS HQ order over the Texas Service Center to hold all the July 2007 EB-485 applications abeyanbce and not to return the applications to applicants. Unconfirmed sources indicate that because of the order, the Texas Service Center is not returning the EB-485 applications which have been received since July 2, 2007. However, there is no evidence that the decision is necessarily related to its potential decision to withdraw the rejection decision. At this point, its reasons are completion unknown. Please stay tuned. "

    You are a citizen of one of the countries listed below, and the worker on whose record your benefits are based lived in the U.S. for at least 10 years or earned at least 40 credits under the U.S. Social Security system.

    Thats the confusing part

    This seems to indicate someone else will get benefit payments but not the worker himself / herself.

    I�m bachelor. I�m planning to get married in another 6 months. Should I apply for I-485? If I should, can I add my spouse later to the I-485 application before I-485 is approved and priority date is not current. :confused:
    You will be able to file her 485 after marriage and before your approval only if your priority date is current. I am in the same situation and confused too.
