Hello Pappu-
Can IV do something to talk to USCIS officials about I-485 cases (very few) being adjudicated at NSC.Recently, they lost a case for not adjudicating a I-485 for 4 years and the Plantiff also got $30000 for his lawyer's expenses.
I know it is for Aug. 08 Visa Bulletin people who became current, but EB-2 doesn't move, then no other groups will. The problem is with NSC.Please advise.
I would not believe on hearsy and rumors. It can only be verified after talking to USCIS top officials.

This is not about illegal immigration, this is bout how sheriff Joe uses the nativist sentiment of Arizona for his own political interest. I have been residing in sheriff Joe's jurisdiction for 5 years now and violent crime has gone up more than 60%. Response time to emergency calls is up drastically, and I have personal experience of that. There are 40,000 felony warrants pending on sheriffs desk, and yet he takes his 50 deputies for so called illegal immigration sweep, which contributes only fraction of a percent to the number of deported illegals from Maricopa County. He has been absolutely successful in creating an anti illegal image that keeps him in his seat for years.
Exactly. Crime has gone up primarily bcoz of illegals.
Sherrif is trying his best but the DHS is hell bent in taking away his powers.

I am already paying tax on my mortgage, I dont want to pay extra taxes for growing vegetables in my own backyard.

I will contribute $25.
How to contribute? I have a regular payment going out to IV. How to ensure this one goes to this separate bucket and not mixed with the general contributions.
If this has been discussed in the middle of this thread - please consider updating the first post with the info so that we don't have to dig through pages of discussions to find it.

If you really think about it bro, we would have been better off not knowing this instead of knowing it...
what difference would it have made, if he just kept this to himself rather than disclosing it? how is getting this information out a great service to the people whose priority dates are current?
i was stressing out day after day waiting to see the magic email, strangely enough this piece of info has brought a closure and suddenly i am finding myself getting back to my normal routine.
I dont think getting this info out is a great service(i never said that) rather just mentioned to acknowledge effort/time someone put in to getting this info.
Whether u believe it or not is upto you, personally i have hopes that folks will keep seeing approvals.
peace

Thunderbolt,
I am glad you finally did the right thing for you and your beloved baby.
I hope you get out of the case with less or no damage to your immigrant status.
Sorry, I was so harsh on my other message, in insbabys own words: threatening.
Take care and good luck.

Every week I take time to do some research so that I can be on top of the immigration updates, and why not?
Attorneys have absolutely no clue about the problems and despair we are going thru. They drag heels on simple processing and documentation work, oblivious to the fact that even a single day just adds to our woes.
I need to plan more than 6 months in advance for any major change in my life , be it marriage, having a baby, investing in property - u name it. Every single life event has a big question mark after it. Will I get the visa stamped? Will I be able to extend status? Can I do this, Can I do that? Well I guess life has an immigrant in the US (legal or illegal) has a question mark ?
I am going thru this frustrating non-ending wait to get anywhere close to permanent residency. I had filed for labor - Then came the DOL overhaul, where labor certification decisions are rolled out in the most haphazard, and random fashion one can ever imagine. Unable to wait any longer I even quit the company that filed my LC and joined another company
I am waiting for the new co to file a new LC under PERM - Again I need to wait as LCs can't be filed immediately for new hires - Even finding a co that can provide immigration benefits along with other personal benefits becomes a challenge.
Now I wish my old LC never gets approved - It remains pending for a few more years - at least I can get incremental h1b extensions. (thanks to the AC21 silver lining)
I just have another year left on my H1. I have worked for over 5 years legally, never going out of status, paying all taxes.
My spouse even gave up the idea of working here legally. The long wait for immigration benefits is now a part of my life - All I can do is pray that our senators when going for recess while discussing immigration; get some thought into their heads abt the nightmare that legal immigrants go thru....

I am in the same boat as you are ... There is injustice everywhere? As explained, I feel unjustice becoz EB3 can port to EB2 , I feel unjustice becoz L1,L2 get it quickly .. list continues. FYI... I came well before most of you guys in queue. PPL who came after me got Labor very quickly and are ahead of me.. So is that not Injustice to me? Shouldnt USCIS be notified and Shouldnt IV followup on adminFix ? when ppl jump or port dates from EB3 to EB2 dates will no go beyond ( just with 3k numbers) shouldnt IV followup and do adminfix so that some set of ppl will stop discussing this issue ? We can keep discussing things that will never happen.
When USCIS stopped Labor SUBS it filed in federal register and many processes. As per Law it allowed to port dates as it does now between Eb3 to Eb2. how can they go back hich is non existing and change the dates just becoz some ppl feel injustice? look at practicality?
As i said just google it and you wil know whether USCIS alredy know about it. again why 2007 is that becoz you call could apply then? When USCIS did admin fix did it change the validity of existing EAD's or said will apply for new ones only?
Those who came between 2000 and 2005 are not getting GC approved , because of some loop holes , those who came in 2007 are getting 485 approved. Is it not unjustince to people who applied earlier? This issue is not similar from EB3 to EB2 etc.
I hope IV will bring this to the notice of USCIS ASAP.

I would say for EB-2 India
In 2005- 2500
But I do not know how many would be EB-2 India in 2004 between Apr.-Dec.
I looked at the links you have provided and I'm still not sure where your "50,000 EB2 India Labors...." came from. These numbers do not seem trustworthy or reliable.
Here's data directly from the DOL ETA website.....
3/28/2005 to 10/28/2005 there were a total of 15973 Labor certifications approved - that includes EB1, 2, 3, 4 for all countries, and 3734 cases for Indian nationals in EB1, 2, 3, 4. Of course a part of EB1 and all of EB5 don't need labor certs.
If you download the database from the DOL website, apply filters for India, approved cases, then filter out all Level I in all non-managerial occupations, followed by non EB2 job descriptions - you end up with ~ 8 - 9% approvals for EB2-IN which is approx 1300 - 1400 primary applicants.
In my estimates, i removed most computer programmer level occupations as the USCIS has been very reluctant to approve EB2 for these cases - i could be wrong here.
As you see, it is IMPOSSIBLE for EB2 IN cases between 3/28/2005 to 10/28/2005 to be much more than 3800 (that is approx 3800 x 2 visas incl dep).
A total of nearly 50000 EB2 IN applicants (including dep) for 2004 and 2005 may be possible.
The massive retrogressions we are seeing is mainly because of the fact that only 15439 EB2 visas were issued in 2003, and 32532 i 2004 thanks to DOL backlogs and mis-interpretations of the law by DOS !!!! compare that with an average of 43,000 in most other years since the 1990s.
I'm pretty confident that your numbers are incorrect
