I-539 only allows you to change status between various non-immigrant categories. It seems that reentering the country on H4 is the only way (there may be some way to do this other than that but i am not aware of it.)
If your H1 is valid, why even bother trying to change status in the US? Simply have wife come back on an H4 and all will be good, I am sorry i couldnt be of more help :(

I'm not from IL. ( I live in MI).
However I'm interested particularly in your state as you have the bete noire of H1Bs - the infamous legal immigration killer - Mr. Durbin as a Senator from your state. Anytime you guys plan a rally outside his office ( or thousand IV members meeting Mr. Durbin program), do count me in.

what is the deadline for the final letter and when can we start the campaign.
Also I would really appreciate if someone can post the instruction on how to send the fax.. step by step so that the non IT layman also can do that.
Please keep bumping this post and put a poll on this thread or start a thread just to get the count on how many did it.
This is about illegals. Do not fall for that trap.
These organizations are looking for bodies to send faxes. Illegals do not know computer and English. But programmers who sit in a cubicle all day and have plenty of time to go on websites and post, are a perfect fit to further the agenda of this organization.
Just ask yourself:
Has this organization leader spoken to you or IV asking for support and promised that they will work for legals?
So why are you promoting them?
They will not do anything for you if CIR comes.

Nice of you abhijitp, I amd northwest part of country won't be able to make it , But I am telling my friends in Tri-State and VA to attend that
Not to single you out, but why aren't people from the West willing to attend the rally?
1. Too much workload (cannot afford to take even 1 day off)
2. Cannot afford flying into DC, accomodation, etc.
3. I didn't attend the SJ rally, what will they say if I attend the DC rally;)
4. DC Rally is a waste of time, I do not support it
5. I don't have to have a green card, I can live without it, for the next 10 years!
6. I am happy to eat the fruit of someone else's hardwork, I don't want to put in any hardwork myself
Answers:
1. Oh come on, how do you then keep browsing IV for so many hours?
2. We may be able to help you... go here:
http://immigrationvoice.org/forum/showthread.php?t=12441
3. Don't worry, as soon as you attend the DC rally, you will have washed all your sins in the past:)
4. Thank you... but why are you even reading this?
5. Great... maybe you should ask your spouse and children too... how long do you want them to go through all that they go through... because of your temporary status
6. I envy you... for I cannot even imagine thinking like you! But please at least thank IV when you receive the fruit of its hardwork!

If you have a 3 year H1 extension (like I do now) you can get a stamping for 3 years and wont get tied up in AP extension filing etc. With the flood of applicants in July I think USCIS is going to take much longer to process AP/EAD and I am expecting periods between APs where I would be stuck, unable to travel. With a 3 year H1 stamp all those issues go away.
Traveling on AP also has the funny effect that your I-94 would be stamped to the expiry of the AP (1 year) rather than H1 (3 years) and I dont know what happens when that I-94 expires... H1 travel is simpler once you have a long lasting H1 stamp. Main advantage of AP is I can renew without leaving the country and if my I-485 ever gets approved when I am outside the country, I can re-enter (my H1 would be invalid at that point)
Thanks, that explains. I realized only couple of weeks back that i didn't need AP since my H1 stamping is valid until 2008 end and hopefully my GC will be approved by then. Anyway now i have backup since my AP also got approved yday.
btw, i read somewhere here that when your AP I-94 is about to expire you ammend that with your H1 so you will have the H1 expiry date.

I would consult an attorney to understand your residency status..
usually at the time of filing your tax you do declare your residency status (like you are a resident of X or Y state..(if i am not wrong)..]
I think its a legal loophole they are exploiting..sad;-(

Sorry to hear about the denial bro. 3 yrs + PG Diploma stands no chance getting an EB2 approval regardless of your experience. It sucks bad but its the bitter truth. In my honest opinion please do not waste time and money on lawyers in continuing to pursue that case. You should be able to verify this in so many other threads discussing this topic from people's personal experiences.
Get your case started in EB3 category ASAP with right educational requirements and maintain a valid H1B!!

First thing is why members have found that title is scary? I dont think it is scary......it might attract your attention. Probably most of people who got scared might be using EAD or are considering using it.<br><br>
I think using AC21 does not imply that 485 will be denied.<br><br> In a hypothetical situation lets assume it is denied we need to find why it is being denied? One can always switch to h1b (with previous employer - should be valid when AOS is denied) by going to home country and getting h1b stamp on passport but even before you have to do it you can appeal in court and you will be able to stay here.
<br><br> I was discussing the same issue today with Ron Gotcher ( you can find it on his website as I have the same userid) and he said unless you are inadmissible or commit a fraud or have broken immigration law in past AOS is not denied. Just in case if you have done any of the above three things then your AOS can be denied and you can not even get any type of non immigrant visa..........<br><br> For using AC21 just make sure that:<br><br>
140 is approved<br><br>Your GC sponsor will not revoke 140<br><br>Your GC job description and new EAD job description are same or similar (title does not matter) <br><br> ONet code for both the jobs match.<br><br><br><br> If you ensure the above things then there is no issue using EAD for a job after 180 day of filing 485.<br><br> Hope this helps and people who got scared does not gives me red dots for speaking aloud.
<br><br> Support IV and make the difference for yourself and everyone else in the immigrant community.
Thanks for your input.

Swede, Thank you. We need more people like you.
And to think of it so many people who could come to the rally, who are struck in the logjam and should come to the rally, did not come. It is a shame!!
It goes to show that IV represents everyone and not just Indians or Chinese. I am proud of all the Brits and other Europeans who not only joined the fight but led it from the front.
I was the guy from Sweden. I agree with the Russian student.
The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.
I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!
I was glad I showed up at the rally just to hear all the peoples' stories.
Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...
You are in trouble until you get your green card in your hand.

How do we know if you have 40 credits?
Where do we check or compute this?
You usually get a SS statement in mail after you have filed your taxes. If you don't, then there is a way to request the statement from www.ssa.gov.

WASHINGTON - Key senators tentatively agreed on a plan to revive a stalled immigration bill on Thursday, aided by President Bush's support for a quick $4.4 billion aimed at "securing our borders and enforcing our laws at the work site."
Officials who spoke on condition of anonymity said Republican and Democratic supporters of the bill were presenting their proposal to the Senate's top two leaders, who in turn arranged an early evening meeting to discuss it.
Precise details to be presented to Majority Leader Harry Reid, D-Nev., and Minority Leader Mitch McConnell, R-Ky., were not disclosed.
In general, according to officials familiar with the discussions, Republicans and Democrats would each be accorded roughly a dozen chances to amend the measure, with the hope that they would then combine to provide the 60 votes needed to overcome a filibuster by die-hard opponents. The officials who described the emerging plan did so on condition of anonymity, saying the negotiations had been conducted in private.
The legislation has generated intense controversy, particularly for provisions envisioning eventual citizenship for many of the estimated 12 million immigrants now in the country unlawfully. The bill also calls for greater border security and a crackdown on the hiring of illegal employees.

"We're going to show the American people that the promises in this bill will be kept," Bush said, two days after launching a personal rescue mission.
Bush supports setting aside all the fees and penalties in the bill solely for tougher security on the border and workplace enforcement, White House press secretary Tony Snow said earlier Thursday. The president on Monday morning will make the announcement of his backing for an amendment that two Republican senators have proposed to accomplish this end.
The provision would immediately divert $4.4 billion toward border security, with that amount to be paid back once the new fees are in place, Snow said.
With many questions unanswered, it was unclear how much of a concession the move amounts to for Bush.
The White House did not have an estimate of how much money the provision would generate yearly toward border security. It also could not say whether the money would be in addition to currently planned border security funding levels or just a way to dedicate funds to that purpose. And it wasn't clear what budget account would be drawn down to pay for the initial $4.4 billion.
The aim, Snow said, is "trying to get money to the border right away."

how is it determined how long the EAD will be renewed for? If there are no fees associated with filing the renewal, then it probably doesn't matter.

--That ought to suck every bit of sanity left! I know "should have..would have..." doesn't matter anymore but I am curious why you did not opt to do labor substitution in june-july period. You should have had a crack at it.
I know people on h1 with consulting companies did better than those who got stuck with one permanent job.Stale career , stale pay and so on...
Do your best and make most of h1b.
Switched from one FTE to another FTE where I was probably the only H1B FTE working with a bunch of contractors and company would not file labor until first appraisal was done i.e. 3 months. By the time the slow-arse attorney completed the PERM requirements it was already September end. It's just frickin crazy,I know, stupidity on my part too in changing jobs. But opportunity knocks on the door once and was not unfortunately in sync with the idiosyncrasies of CIS and DOS. Hindsight is always 20/20 and no point whining. But having to constantly look at the lucky guys makes me say "Kick the H1Bs out; they took my greencard" :D

What were the auditors doing?
Is this just the tip of the iceberg. We know thats true in the US as well. Publicized scams/scandals are usually only an example of what goes on in general (GAFFS !!) Generally Accepted Financial Fraud Schemes instead of GAAP Generally Accepted Accounting Principles
Whats with all these white collar crime in the world...have people forgotten how to earn a honest meal??
