Does any one know how mant days it takes to get denail notive .I-140 denied on April 22 and says notice mailed but didnt recieve yet .Both emploter and attorney havent recieved any thing yet .Is this Normal ?

Mine says a notice was sent that it is approved on sep 26. mSo far nothing. I was told my attorney will get it.....

We submitted our EAD application in June first week and we got our card this week, effective from last week of July for the next one year.
Our priority date is October 2006- EB2 and we are not current. So shouldnt we have been issued a 2 year EAD?
Also we gave our finger prints last year (July 2007 filer) but this time too both the EAD cards shows no FP available .
The EAD card of my spouse (he is the primary applicant says signature waived) I still have signature on my EAD card. Anyone else with the card that says signature waived. Previous card had his signature in there.
I heard that's the way it should be from Aug 1st... :confused:

This is the sort of thing that should make folks wake up and smell the coffee. Advocate for yourself or lose the dream. Those of you hoping to wait it out, whether it be 5 yrs or 10 yrs, let this be the warning shot. What makes EAD holders immune to these sorts of things? Nothing is certain in this environment.
Physicians recently faced a scare(last year) when the USCIS TSC unilaterally started deeming MBBS degrees undergraduate baccalaureate degrees and declining EB2 petitions for them in spite of nearly half a century of precedent to the contrary. This in spite of the ECFMG, ACGME, State Medical boards(vested with the task of determining qualification to practice) etc all recognizing such foreign degrees for Medical/Surgical Residency training and subsequent practice.
It was only after months of lobbying and various letters of support from medical organisations, and meetings with the USCIS by some prominent lawyers like Greg, that they relented.
If that can happen out of the blue to International physicians typically working in underserved areas. Then those of you who feel an EAD card makes you immune are living in a fantasy. Take a stand, organize better and advocate for yourself. There will likely be a narrow window later this year for us, there must be a better effort.
BTW. It took a friend of mine 7 months recently to get his EAD card. No explanation, no nothing. He did not push the issue because he was on a H1b visa, however those are the sort of things that can happen.

We paid with one check for: two I-485�s, and two EAD�s. In little space on the check where it says �for� I wrote fees. If your both I-140 has been approved then your new PD needs not to be current for interfiling. But make sure that your to-be-used I-140, PD must have captured.

Why don't you ask your parents or some one who can help you to check with Registrar if they can apply on your behalf if you give power of attorney?I think this is the first thing you need to do if not yet.
If that is possible they can provide copies of your passport, marriage photos.

As a Primary Applicant my GC was approved (EB-1) but for my wife's application I got an RFE. RFE - USCIS is asking for a VALID wedding certificate showing proof of a hindu wedding under hindu act (dont ask what I was doing or what my lawyer was doing while submitting 485)
Now I have about 28 days (total is 30) to respond to it. I have not rcvd. my GC but it has been approved and has been sent to production. My lawyer told me that as my GC has been approved my VISA is not good anymore. My wife was on dependent visa and so is my kid.
Now as my GC got approved.......my visa got cancelled...........my wife's & kids visa is invalid.............and we did not file for Advance Parole so we cant travel. On top of all this we dont have a wedding certificate.
Any suggestion to address this situation? I cant get a certificate without going back to India and I cant leave the country as If I do so I wont get to enter the country again. Even if somehow (on some legal basis) I can re enter I dont think my wife and kid will be able to re enter US.
If I dont produce evidence then my wife's application will be rejected putting her out of status.............gosh what a mess.....
ANY SUGGESTIONS FROM ANYONE WILL BE HIGHLY APPRECIATED. Murali please respond with any possibility which I can explore upon.

Premium processing for 485 will not solve any of the Retogression issues unless there is visa number increase or other provisions in CIR or SKILL.

You should not have quit the job under mere threat of lawsuit esp. when he did not have anything to hold over you anyways, In future, of course, just to be on safer side, send a back dated letter with your resignation and date it to your last working date for that employer that way your 12 month counter starts from that back date..

Our FP were sent back to USCIS the same day - 10/1/07.
What does this mean. The lady didnt have any information on name check. Seems like there is no way of knowing anything about name check!:mad:

I happened to know this from my friend - Get an infopass appointment and maybe an immigration officer might be willing to help you. I don't know how far this is possible since I HAVE NOT TRIED IT. For the August visa bulletin, USCIS gave all the extra quota to EB2. I don't think this is fair for all the EB3 people. I thougt the reason they gave all the quota to them was the EB2 included NIW. But NIW is just a small portion of EB2. Majority EB2 peopole are like EB3 working for companies and not necessarily important to give all the extra quota to them. If the policy continues, our EB3 will just become fake immigration. You don't know how long we can finalize our case. Gugs, please work together and let our voice to be heard by USCIS. Hope our organization can help us.
