I think when you are 35+ and 'you are in the 7th/8th/9th year of H1b with no idea if/when you will get GC' it's practical to invest in business.
While we are at it let me throw this in....
Assuming you decide to persue MBA from a good university instead of online. What kind of investment of time and money are you looking at? Is it really worth the investment when you are already in your 30's? Is is worth spending the time and money on a MBA? If you spend the same time/money on a business opportunity wouldn't that be better in the longer run? Is it practical to start a business when you are in the 7th/8th/9th year of H1b with no idea if/when you will get GC? Is it a safer bet to invest in education?

All the members in this forum please start taking active part in determining your future your families future and your kids futures.. please do not be short sighted or procrastinate. Take Action NOW, we can do this, please encourage one more person to join in and contribute, talk to other people who are not aware of our plight and educate them, contact your local lawmakers, be active on the forums, support the core members and each others, come on now guys.. may be all of us cant do every thing but try some things at some of the times and some other things some other times :) -- does that make sense .. I wish I was very rich I would have made a HUGE donation to IV to fight for their cause... I really respect the core members for their tenacity, dedication and inner strength to carry on this effort.. admist so much uncertainity and so many obstacles .. and the best part is .. most of the people who will benifit from it dont want to do much about it ..... ok .. I am exhausted now.... Logic Life .. how do you do it .. keep churning out .. one passionate and well thought out post after another .. For PMP I think, you need to take some courses, I had taken some courses at Berkeley Online on project management, these courses count towards PMP.
They also have in class courses, if you are interested.
Better to do something than nothing.

Not all professions can apply for H1Bs. You need to have specific skills that the US does NOT have. Someone on here had once posted that his wife could not work as a teacher although the school was ready to offer her a job, coz there is no H1B category for teachers. The H1B visa cannot help spouses in all professions. Hence my suggestion.
About how this will solve retrogression, IT WONT. My point is instead of trying to bring this retrogression beast down, maybe we should look at alternatives to work around it.
If it is not the skill that US does not have then what argument are we going to give to lawmakers for asking for such a provision ?
You need to restart ur GC process but you can keep ur PD (if not revoked) and get a 3 year extension immediately based on the Approved I-140.

When you call the law makers and tell them you support XYZ bill.. my question is what do you get out of it!
When the lawmaker realizes that he is getting 10000 calls from LEGAL aliens,
>who are not from his constituency,

>who can�t contribute to his election campaign�
what is the motivation for the law maker to support the bill�
So to avoid sounding stupid and foolish and desperate when you call� a more logical approach would be to :
a) Generate a public petition form on IV website and have all the members� login and sign the forms digitally�
b) Then have IV reps.. fax them and send them to lobby groups �.
c) Lawmakers will listen to one talking head�and not worry abt 1000 calls that borders on ..�saar �support the bill saar�..
How many of you have actually talked to the lawmakers? Its always the assistant!
But instead .. someone says we have a signed petition of 25000 members effected by immigration mess �. And it�s a hi tech workers lobby group ..every lawmaker will talk to you and not the assistant!
Conclusion: calling the lawmakers haphazardly is actually hurting IV cause..to a certain extent!

Longest I have seen a 485 denial go without getting reopened is 5 months.
If a person doesn't have h-1b then six months is a magic number. If person overstys six months and uscis ultimately denies it again then person is in terrible situation (3 year bar).

it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.
Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.

there are two factors here:
1. Regarding consultant coming to US. As employer told he does not have bonafide job offer. he is at 0% fault and consultant 100%.
2. Regarding paying for h1b fee. employer obviously did not make money here but he was not supposed to take money from consultant.

True, but you are forgetting the basic definition of demand. Demand is willingness to buy supported by ability to buy. If you are from any metros in India, think how many of your Non-IT, mainstream friends draw more than Rs. 50,000 per month? How can someone making even Rs. 50,000 a month afford 50 Lakh flat?
If there are 10 people drooling out side Ferrari showroom that does not mean there is demand for 10 Ferrari :)

This estimation ignores other NRIs in other country. Apart from this there are many resident IT folks makes 6 digit salary plays the role. If most of them tries to buy, we need to find another India. Indian real estates become a NRI colony,
