Does she need her H4 approved to have her prospective employer file the I 129? (or) Can she just provide the notice of action she received for her H4 extension filing along with her I 129 to show that she is maintaining status?

My lawyer told me that my H1B status is maintained for 240 days after my visa expires.

Completely agreee with hari_baby22. Couple of days back I posted that immigration voice could get a lot more donations if they publish there earnings/expenses report online and make everything transparent. Lot of people including myself, do not contribute because they dont know how funds are getting used. My post was deleted by administrator and I got following message -->

I called USCIS regarding this issue. Representative mentioned that once u have GC, it is your choice if you want to change jobs. There is no rule stating that you have to stick to your employer who sponsered GC for any period of time. He also mentioned that changing job after getting GC does not affect citizenship application.

i mean it did say about my previous exp but the position for which the LC was certified did not need exp.. thats how the govt off advertise it seems.

The most effective method is to fax your suggestions to the lawmakers� offices across the country. We should start with the sponsors and co-sponsors of the PACE bill. Pls learn how you can access PACE co-sponsors names in the 3rd post at this thread:

Q1) i am applying for the first time for my i-485 that requires i-693 form.
My question is, do i have to submit my i-485 together with my i-693, or do i have to apply first the i-485 form and then wait until i get a respond from the USCIS.
I was told that i am supposed to wait for the respond from the USCIS after applying my
i-485, and the USCIS will designate the doctors for my I-693, which means i cannot choose any doctors on my own. But in this reform , according to the users' discussion, so far i understand that you can apply for the i-693 form regardless if you have already applied for the i-485 form.
Q2) To simplify my second question, while i am applying for my i-485, and before its submission to the USCIS, can i start making an appointment with my local Surgeon?

I have applied for H1B extension with my original h1 company (a consulting firm) and due to some pending queries regarding the h1b applications in general for my company, my h1 extension was in pending state with no updates. (I applied around Jun 15th 2008).
Later in dec 2008, I applied for h1 transfer with a new firm, and got a RFE on Jan 7th with similar requests... My lawyer asked me for all my W2's since 2005 (my original h1 start year), pay stubs for the last 4 or 5 months, and letter from end client, prime vendor and myself stating job responsibilities.. I have collected all this information, and they are going to respond to the RFE this week. I hope all goes well...
I have EAD to fall back in case they reject it. But seriously, I was never out of status, or unpaid (unless while on vacation to india or elsewhere).. came to US in 2002 for masters and worked on CPT/OPT for about a year before starting on h1b in oct 2005.
Looks like they are really keen about the consulting firms' benching etc., Hope we;ll all get thru.

Thanks for bringing this up.. This is a legitimate concern.. Lets just hope this doesn't happen to any of us... Although hope is all we can do for now...:(
Has anyone considered the implications of identity theft, fraud etc if the USCIS does start returning the adjustment of status applications? When my daughter applied for adjustment of status a couple of years ago her application was rejected erroneously and returned to her. When she opened the package, it not only contained her information, but also someone else's highly confidential and personal documents. The documents were completely mixed in with hers - all out of order - and even the other person's check was returned to her. The person's case was also very time sensitive and of an extremely confidential nature.
We gathered up the information and personally returned it the local USCIS office - who told us it happens all the time! We sent a letter to the person concerned telling him what had happened and advising him to contact the office immediately.
Imagine what might happen if the USCIS starts returning the 1000's of July applications. There is a good possibility they could mix up applications, return them to wrong addresses or lose valuable paperwork. They certainly won't return applications via Fedex or UPS - they'll just throw them in the mail without any way to track them.
Many green card applicants, have social security numbers and have been working for years to build good a credit history. Anyone getting hold of these packages will have access to all personal history, addresses and of course the bank account information on the checks sent to pay the application fees. Just a thought . . .
