There was a topic where googler had explained that as per DHS employee, unused Eb2 Worldwide goes to Over subscribed Eb2, so Eb2 India and Eb2 China.
It appears that the policy was always this, but since there were no excess Eb1 in the last couple of years, there was no spillovers in the last 2 years, howeever this year there are higher number of unused EB1.
In fact the way it appears is :
EB4 unused ==> spills over to ==> EB1
EB5 unused ==> spills over to ==> EB1
EB1 unused ==> spills over to ==> EB2 world wide.
EB2 Worldwide unused ==> spills over to EB retrogressed.
So before any spill over to EB3, visas are given to EB2 category.
Since the unused EB2 visas are given to retrogressed countries, I believe that more visas are used by country that has more retrogression. But if there is any future movement in EB2, than both India and China could experience it.

I have not received any. Generally the notice goes to the employer or the attorney who filed the petition on our behalf. Moreover I have checked with my previous employer. They are suspecting the case got reopened because of the H1B withdrawal petition that was filed sometime back. Things will be clear only after they receive the notice.

I see only one problem in this logic! Many cases I know of, at least from the 2007 H1B fiasco, paid for the H1Bs through consulting companies FROM THEIR POCKETS. So to answer your question as to why companies would spend $5000 in anticipation, is that they don't. They take it from the applicant. (again I am not saying all do, but there are abusive companies that do).

It is very difficult to make a prediction...The 7% country quota for china is satisfied already...So it could be this october
The only chance that it happens is that visa overflow from other categories into EB2China/India...For that to happen..Eb3 world has to become current.....
That would mean that more visa are available than can be used for Rest of world...Then CHINA/India would get some more than 7% country quota....
So it could be Oct 07 or if you are lucky... earlier....
If immigration reform happens..you would definately become current immedialtely...

I dunno about which bank is the best but I guarantee this ICICI does sucks! they act like as if they are ruling NRI. and of course like anyone else we had a very bad experience talking with their home loan dept too. Honestly - If I may say something about this....I can say this with 100% confidence that sooner or later we all will witness their demise. count on it.
The point is that they cannot JUST do this to us(NRI) or I can say it is we who made their success if they are really. but by the sheer power of community like this - we can definitely teach them a good lesson by just quit banking with ICICI. guess what you will be proud of what you did in the very near future. SBI still IS doing reasonably well and you still can get better rates though.

how do you guys manage to do options/commodities/fx trading without missing prod release? :) you all seem to have lot of knowledge about all this stuff and its good to learn something new (although one like me need to google to understand what smisachu is saying :D)
I invest in stocks and etfs but am very impatient when it comes to maximize profits.. i like to take small small profits (5% to 7%) instead of one big kill.. btw, can someone suggest good REIT etfs? (sorry, not related to original commodities topic)

Very sorry to hear your case. Based on what you said, no one in other cars were disabled or had life threatening injuries. So it is unlikely that the Judge would grant that much money from the Insurance company or you.

This is in reference to a thread about feeling depressed by retrogression or labor backlogs to stuck FBI namechecks or whatever it is that depresses you. Not criticizing anyone in particular so dont aim for me.
Yes, and a lot of people know that there are highly skilled people who are depressed and that takes a toll on employee productivity.
After all, if 90% of your time is spent on thinking about BECs and visa bulletins, imagine if that time was spent on doing the job they've hired you for.
Some employers(like Microsoft) realize this and want to do something about it. Its not just about keeping the best and brightest here in USA. Its also about keeping the morale and productivity up.
As to how to deal with this...try this.
Call your local congressman's office(Find out info about that from House.gov, with your zipcode). Get an appointment with congressman. There is an Easter recess coming up when they would be back from DC.
Then talk to him about all issues you have. Take all the material you need from the "Volunteer" menu item of this website.
Doing something about the problem is the best therapy there is. I am not saying this because I want to coax you into meeting your congressman. No. That's not the objective. But I think action is the best remedy for this problem. And there is actionable stuff to do about this. If you are suffering from terminal cancer, then you really cant do anything about that. This is not such a problem. This is a problem for which the solution is out there.
Somehow, after landing in this country, people lose the appetite for risk and adventure. Before they are in here, they would move mountains to score an H1 or an F1. After coming here, they hunker down, heads-under-the-desk kind of approach. What I am talking about is nearly 200 people right now, who have read this post, but havent logged in. They wouldnt log in. They wouldnt give their real email address if they sign up. They would never contribute. WHY? Because they are afraid. That they will be deported. For no reason. Everything we do is legal, including raising funds and spending it on lobbying. But they are afraid. They are also afraid that by talking to congressmen, they will make them mad and the congressman will pick up the phone, call USCIS and then get their 140 cancelled. Yes. People create their own fastasies and become afraid of them..
Yesterday, nearly 2000 Irish illegals went to capitol hill (http://www.ireland.com/newspaper/frontpage/2007/0308/1173121325488.html)and talked to various lawmakers to lobby for CIR and legalization. They were illegals. Yet, the somehow managed to walk into the building where laws of this country are made, talk to people who make the laws that they have broken, go thru Capitol Hill security check, and look into the eye of the lawmaker and talk to them.
However, our community, this is how they behave. Forget about talking to congressman, or contributing money. When they call the core group with a question, they block the caller id can call. Dont disclose their name too. Ask a questions and then quickely hang up. Some of them want to contribute with cash because they are not willing to believe us that we are doing everything legal here and its their right to lobbying and petition the Government for problems.
After paying taxes, after following all immigration laws, after getting all the education in the world to become "Highly skilled", the highly skilled cant bring themselves to stand-up with a straight spine, thump their desk and talk to their lawmaker.

I was seeing lot of posts in this forum about reverse brain drain, so I wanted to comeup with a question which would answer my question without doubt.
I wanted to see if all those who are in the GC queue and think that they are a very important for America and insist on that in their signature by saying "Help us stop reverse brain drain" are really meaning what they say.
I beleive if we are so much in demand we can get a job in another country and have similar quality of life or better. So only poeple who are confident of the reverse brain drain and America should stop it will not hesitate to vote "Yes" if they are so frustated with the GC wait times.
Once again thanks to everyone who so far particiapted in this poll and posted comments.

You said it. Some years ago people who filed in wyoming get lc in 3 months
and got GC in 1 year. I know a friend who completed the whole process in 11 months :)
What to do? This world is a big unfair place. we have to live with that I guess.
Congrats buddy ! Its quite ironic that there are some people who filed a few months here or there from your PD in 2000/2001 and are still waiting for their GC and I know a few people who filed for GC in 2003/2004 and got it in 2005.
The odds of getting lucky with USCIS are worse than hitting the jackpot .

I agree with PlainSpeak, it is better to get it evaluated. Also, sorry i did not read your earlier post cleary. Both my friends did a MBA and not a MCA. I know of a collegaue who is in the process of applying under EB2 and she has 3 year MCA degree in addition to her 3 year Bachelors.

immigrationportal has reported only 2 cases of rejection for july 2nd filer. Their package returned back and received by party(around july 10th), per forum there.

From Greg's yesterday's latest response that there were very few which were returned/rejected on July 2nd itself and this thread proves that we are not alone ...there are so many and status is unknown. Matthew Oh is also suggesting that it will be receipted. I think we are all safe and with time we will get receipt. Nobody...none of the attorney's are suggesting refiling. Now the thought that whether my packet was properly filed or not? I think that will always be there in the back of one's mind but if the attorney has done his/her job correctly I think we should not worry. Its not rocket science and documents required for filing are well known...so I would discount this risk. It appears we are all safe because as we all know that no rejection notices have been generated, packets if returned should have come back by now as per Greg....All in all it all points towards our packets being on hold there at respective centers....but as you rightly pointed out..towards the last week of July keep calling centers to know..but even before that keep eye on check clearing as that by far is the best and earliest clue that all is well with the case.

Can someone work for company A (with green card pending for 8 years) and start green card process thru other company to port to EB2(part time employment). Can they do that. I mean basically working for two companies until you get your green card, then quit company B and continue working for company A. Did anyone do this? Is this a possible scenario?

So How come all we hear from the core team is requests for contribution? There is no detail of any actions/efforts that are happening currently? It will certainly be more engaging for all members to at least know what efforts are being worked on currently? I think expectations need to work both ways otherwise you just have an autocratic organization that has to follow and do as the leaders choose to do. Just my 2 cents and all you frustrated folks please take a deep breath before jumping in.

4-9 years ago, when used to send large amounts ($4000, my family was in India), I used BOA because I had bank account with them. They would charge me US$45 per transaction. Seeing that others are charging $10 or so, I reached Manager about such descripency. He explained that after taking $45, BOA becomes my representative and works in my best interest. He showed that last conversion rate was $1.50 more than any bank published rates in India on that date. So I made effectively $40-50 even after paying us $45. BOA manager explained that they gave Times Bank Indian Rupee. Had they given US$, Times Bank would have eaten all the profits.
With others money transfer agencies:
#1. I always got approx. $1 less than published rates.
#2. There has been delays
#3. They have deleberately taken more number of days to do transaction on that day, when rates were worst.
I never lost money by sending through BOA, it used to be $4000-5000. But since BOA charges $45, I could not use their services for money less than $2000.
$45 had made trustworthy partner, free/$3/$5/$10 made stealing partners.
