Thanks for the responses and sorry for Confusions..
I am giving the scenario more clearly..
My name Before mariz is"Venkata Naga Sunita" surname: "Prachina" (changed identity).
After mariz surname changed to "Naveena".
When I applied for H4 alongwith my husband's H1B, I had my passport with old surname(Prachina). That passport got stamped for H4. Later I got another passport with surname changed(Naveena). At this point, I have one passport of old surname with H4 stamp and another passport with new surname.
While entering into US this January, on I-94, I wrote "Venkata Naga Sunita" Last name: "Naveena". In March, DMV ppl told me that the name in the I-94 should match with Visa". When, I applied for H1B in May with this new surname and attached this I-94 that has new surname "Naveena".
During H1B processing, I had to visit my home country on emergency purpose and got approval of H1B on Sept 7th, which is valid only from Oct 2nd. I re-entered to US on Sept10th and wrote my last name as "Prachina" on I-94(to match with current H4 Visa with which I am entering US). When I recived my papers this week, I was happy to see that my Change of Status is approved and surprised to see that my name on the I-797 and attached I-94 is printed as "Sunita V" Last Name:"Naveena".
Now, the I-94 number and name that are present on my I-797 are not matching that are attached to my passport. Is this OK or going to create any problems in future(SSN or stamping)..

You may be right. But with your logic all these talk about opening an SR, getting an infopass and blah blah is not right then. We have polls here on what worked....that's what i was telling it is too much of a coincidence. Opening an SR won't make a sick IO healthy and come back to work..taking an infopass won't bring a dropped out file back in the pile...talking to senators and congressman are useless anyways....
So bottomline is all this talk about what works or not is a pure guess and nothing else....USCIS has always been a black box and will always be..

Just as in any other trade, surely there are many abusers, however, this economy fueled itself to the top of the world in a lot of things using talents from around the world and that was mainly via the temporary work visas including H1b. Now you might meet 1 person in say 100000 who falls into the catagory you mentioned and none of us entertain such people with any respect.

Our friend was the one who got the labor sold by his desi employer leech..to him
its good atleast that Ac21 works and it should..now with substitution banned the new AC21s will be protected..as long as they didn't substitute..
Finally labor substitution was a bad choice! thats the moral of the story..

There is no excuse for the Immigration dept for this backlog. This is a simple clerk's job which they screwed. IV as a an organization should clearly state it and insist on fast resolution by the respective authorities, not just foggy promises.
I agree that there is no excuse for processing times running into many months. However, I would be hesitant to rely on the goodwill of DOL/USCIS in resolving the backlog. I started another thread suggesting a premium processing option for the entire GC process:

IV team, please consider the following:
1. IV can post free ads in classifieds like sulekha, indiainfo, craigslist, free ad newspaper, etc.
2. also IV can contact all indian/asian associations and Asian student association in US to place an free ad in their websites/magazine/email newsletter (some have annual magazine, some has monthly newsletter). tell them how IV helps its members in visa/gc related issues including free legal advise.
3. IV can place free ad/info on notice boards in indian/pak/chinese restaurants, indian/pak/chinese groceries, temples, conference halls, etc...
4. increase IV site listing in search engine results. any combination of keywords in gc or visa should bring IV site in top 10 like when searching any US visa (like H1/H4/H1B/F1/J1 etc.), gc related keywords (like I-485, PERM, labor, I-140, immigrant, FingerPrinting, etc). This can be achieved for a little money and this can be done by contacting yahoo/msn and other SEO (Search Engine Optimization) companies. Our members can help us in this regard.
5. Send newsletter email to all IV members atleast ONCE a month and ask them to contact their friends/coworkers/their company employees to join IV.
This newsletter will request members to contact indian/asian association in their local area for membership drive.
Also request them to send feedback to improve IV and to increase publicity and membership.
6. Create "Free Legal Advise for Employers/Schools Only", where employers/schools can send visa/gc related questions and attend conference call during this session. This is an addition to the current one which we have now (which is for open public).

Has anyone considered the implications of identity theft, fraud etc if the USCIS does start returning the adjustment of status applications? When my daughter applied for adjustment of status a couple of years ago her application was rejected erroneously and returned to her. When she opened the package, it not only contained her information, but also someone else's highly confidential and personal documents. The documents were completely mixed in with hers - all out of order - and even the other person's check was returned to her. The person's case was also very time sensitive and of an extremely confidential nature.
We gathered up the information and personally returned it the local USCIS office - who told us it happens all the time! We sent a letter to the person concerned telling him what had happened and advising him to contact the office immediately.
Imagine what might happen if the USCIS starts returning the 1000's of July applications. There is a good possibility they could mix up applications, return them to wrong addresses or lose valuable paperwork. They certainly won't return applications via Fedex or UPS - they'll just throw them in the mail without any way to track them.
Many green card applicants, have social security numbers and have been working for years to build good a credit history. Anyone getting hold of these packages will have access to all personal history, addresses and of course the bank account information on the checks sent to pay the application fees. Just a thought . . .

I have 4 years degree with Masters. However, if you made through EB3 you should be able to get through EB2. Nevertheless, it is worth a try as gains are large. I understand there is a risk (no risk no gain).
I have just started the process and my labor is in process. I am filing with my current employer who filed my EB3 case. Green card is for future job so they are taking me for higher position say manger. My lawyer is making sure there is some kind of sync up with Eb3 labor and H1B application. They should be supporting the present labor application.
Your employer need to be supportive and should be willing to work with you that help a lot. They have added some managerial stuff and kind of technical lead. I have not used my experience with present employer.
To best of my knowledge, there is no impact to eb3 case.

Congrats on getting your green card. Your post and attitude is the exact reason why DOL has made it almost impossible to get EB2 certification especially in the software field and why people despice consultants like you and your desi employer.

It is because of blatant abuse like this that DOL is cracking down on eb2 filings. People have realized even eb2 india is never going to move beyond 2003 so "consultants" like you and desi companies have moved on to abusing eb1. Seems like you are proud of your achievement just like the L1 folks from desi companies who brag about getting green card in less than an year by abusing L1.
To all the people who think they can pull a trick like mr salawrene by filing in eb2 again hard luck there are 120000 485 applications with USCIS with eb3 and eb2 having about 60000 each, because of abuse in Eb1 no more spillover of visa numbers to eb2 india wil occur so eb2 india will not move forward, on top of it dol is cracking down on eb2 filings. eb2 might start moving backward to 2003 or 2002 and will remain stagnant like eb3 because no visa spillover is happenning.

Here is my situation:
I-140 approved - PD: May '06
I-485 filed - July 30 '07 (India)
EAD cards - Received
APs - Received
Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!
you can be on the payroll of 2 companies on H1 if the H1 petition says that its for concurrent employment. On EAD no such issues, you simply sign new I-9 forms with both employers.
If you are moving to EAD, you can start with second employer right now. If you are going to stick to H1 for some reason, then delay joining the new one by just a few weeks. By the time they file the H1 transfer and the approval comes through, your 180 days will be done or nearly done and you are all set. Its nice that your current employer is helping you out through the 180 days.
Here is my situation:
I-140 approved - PD: May '06
I-485 filed - July 30 '07 (India)
EAD cards - Received
APs - Received
Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!
you can be on the payroll of 2 companies on H1 if the H1 petition says that its for concurrent employment. On EAD no such issues, you simply sign new I-9 forms with both employers.

It is interesting......why does congressman/senatorial inquiry works for some and not for some. What can we do differently. I sent out a "Thanks...but no thanks" email back to Congressman's office.
I mentioned that I expected that a congressman's inquiry will at least make TSC to look into the case and do a due diligence but not throw the same reply that they'd to individual inquiry.
There is a saying in Hindi...
"Jab kismat hi hai gandu to kya karega pandu"

My H1b is going to expire on April 17th. I had found a new job and they had applied for my H transfer on March 27th. I would like to know
1. How many days is required to get a H1b transfer receipt.
2. What happens if my H1B expires before i get a receipt.
3. Should i go on EAD or continue on H1B. My wife is a green card holder for last 3 years 6 months.

A. Masters Degree+3 Yrs US Experience+Permanent Job=Apply for GC
B. Bachelors Degree + 5 Yrs US Experience+Permanent Job=Apply for GC
Get Rid of this country limit.
Intel's CEO once rightly said that,US has to become mean as to who they want in this country, A person right off the boat(Asylee,GC-Lottery etc) OR a US trained and educated individual contributing directly to the economic system.
