Someone told me that taking color photocopy of PR is illegal just like you cannot take color photocopy of currency. Maybe a B&W copy is an alternative.
Btw, why is this hatred towards someone that just walked out of the queue? Blame the system, not the poor individuals who have also waited like everybody else. Instead of venting out on innocent people, do something constructive to help yourself and others. As a donor, pls post responsibly. Guys, give me red if it is wrong to say that.

My 140 got approved yesterday! Just 7 days after they received the response to the RFE. :D
Btw, someone asked abt 3 yr or 4 yr degree. Mine is 4 yr degree.

Since I140 petition is for future employment, it shouldn't matter that you were on F1 when it was filed. However, you may have a problem with adjustment of status. You may have to do consular processing if you are still on F1. But since you've changed to H1, I don't think it matters again. Could you consult an attorney or pose this question at the next attorney conference call?

The brothers also knew that the visa-seekers did not intend to return to India when their 10-month visas expired, a statement said.
Pena twins also travelled to India to assist the Indian nationals with the application process and visited and corresponded with the US Consulate in Mumbai.

The customer rep said that I am in legal status pending my H1B petition. I heard about the 240 day rule. Through my research I learned that I can work and stay in U.S until 240 days of I-94 expiration. After 240 days I can not work, but can stay in U.S peding H1B petition. I am not sure how far this is correct. My companies attorney says that I have to wait or go through the senator to see if your case moves. Aren't we legal as the case is pending. Mysterious laws of USCIS to cover up their own faults.

Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?

If both job (old and new) in same area, and new salary is "considerably" less than old salary, then it may be an issue. But it may be overcome, provided if you know the prevailing wage determination (not salary) of old job. Lets say if the PW for a level-3 engineer for your old job 50K at a particular county, and I-140 salary in your old job is 70K, and if you port to new job with new salary as 60K in same county, then it should not be an issue. Again, if USCIS does not buy this, you need to dispute. It needs extensive lawyering with DOL wage survey as a proof.

You won't get a definite answer because its not a point based system. I think EB2 NIW is easier and current for Egypt so go for that. USCIS lists the criteria (at least 3 I think) that you must satisfy. If not then not much you can do.

Different jobs have different requiremends Hi_Nu, for example, a website for a local golf course has different requirements than a huge corporate e-commerce site. I got my first 'job' like a month ago (I'm 14) and the guy was fine with my age.
Two tips:
-You should tell the person how old you are before you start anything (the person might not want some 14 year old making him a site/movie/graphic).
-Not that you CAN'T speak slang, it's just better not to. I mean do what ever you want, it's just a suggestion.

But with the new rule, it doesn't matter if FBI name check is pending.If your PD is current, whether your name check is pendign or not GC will be approved.
Am I correct?
GC will be approved contingent on the grounds that it can be cancelled/annulled if the FBI name check comes up not in your favour when the FBI finally reviews your name ..In a way, it's a conditional approval till the actual FBI clearance....IV seniors may be better at answering this.
