So in your case, did your older employer cancel or withdraw the I - 140 or it was active. Do you know if you can still port the priorty date if the I140 is withdrawn by the older employer. I have looked at most of the forums and haven't found a concrete answer to this question.

My AP online status says mailed on Sep 11 th. I have not received them yet.
My wife AP online status said Sep 11 th. We received them on Sep 21 st.
What is the normal time frame for receiving AP papers?
My wife's AP papers were mailed on 17th Sep but we are still waiting for them.
Are they sent to applicants home or attorney's office?

Okay. I was able to talk to my attorney just a few minutes ago. He said, to do interfiling , you do not need to have PD current based on new I-140 as this is just a case update with new 140 information. He said that in any case, your 485 will be picked based on PD. I found him very very confident when he was telling me all this info to me.

if you sent it between july 17 and august 17 there should be no problem,, uscis was accepting i 485 forms without medical exams due to the july 2nd trouble.

I agree with the majority of the posts here that talk about bickering and infighting that we have as opposed to remaining focused on our common goal. Just because someone had a bright spark that people with Masters should get Green Cards, is the USCIS going to honor that and change the rules to benefit us? I think we need to remain patient and focused on the job at hand. i.e - supporting the IV front liners and having a single voice which boldly and clearly talks of expediting the green card process. If we are not going to to act in unison, we are the biggest losers!
FYI - I have been in the country long enough and have gone through the pain of bungling lawyers and unresponsive management..so its not that I choose to be +ve since I haven't had any bad experience with this process!!

I made a one time contribution myself but I have a feeling that IV is going away from the goal of increasing EB visas and just focusing on the 485 filing.Many people that have contributed earlier feel that by prioritizing the 485 filing over increase of EB visas, IV has gone away from atleast some of stakeholders .The stakeholders were promised initially that increase of EB visas would be a top priority or atleast on a even keel with any other objectives, but now we are in phased approach.I have talked to lot of people and the feeling is same.

Anyway having + Attitude and is good thing.
just wondering, how do you know when your medical and FP expires ?
I hope they will ask us to go through that pain only when they are about to approve a case (just imagine the mess ..if GC takes 10 years and they ask to go medical every 2 years)

Its sad situation, people are walking away or feeling bad becaus
of IVs decision about I485 filing. Couple of core members already
file 485 and still they support it. Even I filed my I485 2 years ago.
There are 2 things here.
1) Think about people who file their labors 3 or 4 years ago and got I140 approved or in the filing process. If a lay off or something happens they will lose everything. All these years wait, frustration everything... whereas if you have file I485 you have a chance to shift jobs. Their only chance is to file I485.
2) 485 filed people think they will be affected. Thats why they are opposing it. But the point is that since the whole thing is going based on priority date,
it doesn't matter much. With present situations if a person has a PD older than you, he/she will get GC before you for sure (90%). Even if his /hers LC is still pending.( Because PD will move very slow. For EB3 to advance an year it would take 2 years. By the time all the old LCs will be cleared.) I dont see anything to be concerned here. Because we all are fucked up so badly :) :) :) :). Take a deep breath and think about it. The only way out is to collect a ton of money and lobby very hard.
So I request you to work actively, induct more members, contribute
more money to our cause. We will win soon man!!!!!

My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.

I don't think it is true. My lawyer said using AP will not invalidate H1B.
I have seen many people saying they came through AP and extended H1B , some even 3 times.
Anyway, I am travelling outside and planning to use my AP while coming back. I will post a message if I come through H1B

I appreciate both you guys for keeping this discussion so clean and issue based. I was little worried on my first post that someone might spin it personal. Kudos to your mature responses.
Yes, I honestly think that quantity matters in meeting politicians. What is so clear to us may not be clear to them. Not because they are lesser mortals than us, they have a different perspective. Why and How is entirely not up to me to worry about. Someone has a different view and I can only respect that view. I cannot, and do not, think that I must invest my time in brainwashing anyone. I wouldn't call it a crab mentality either without knowing them personally.
With that said, let me be a devils-advocate, if you will, and ask these questions:
Given ours is a issue-based, goal-based struggle, with Goal & Issue being same for ALL EB immigrants:
--- Why should I expect all immigrants to wear any organization's badge, be dedicated to any particular/one organization, whether that Org is IV/Democrats/Republicans/Congress/BJP
--- Shouldn't I be just worried about who can SHOUT louder about my issue and less worried about the Organization that's making them SHOUT?

I agree. Aware members need to inform ignorant members obsessed with notices on other threads and stop those therads NOW. We have tolerated such threads enough. I am not joking, you will see from today new threads of EAD and AP trackers for the next 6 months. So let us all nip this in the bud in the interest of this organization. What do you think?

It's not a tracker and I'm not tracking or looking for my receipt notices to come from USCIS or my checks to be cashed or anything like that.
My notices have already arrived and my lawyer and employer are refusing to give them to me. I have foreign travel planned in October and I might be looking to change employer soon. My question was whether I can invoke AC21 without having the physical receipt notices.
Would be helpful if someone knows for sure.

I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

Ron gotcher makes sense to me. Considering the (quota + spill over) vs. the demand, it is just wishful thinking that all EB2-I with PD < 06/06 will get GC in the next few months. I also agree with others that in Oct EB2-I will retrogress back to the original levels (2004), it could go even beyond (to late 2002 or early 2003) that if a handful of EB2-I (who did not get a chance a last year) file 485 in the next 1-2 months.
2 yr EAD rule and this big EB2-I advancement could just be an unfortunate coincidence. But a lot of folks will sure find a 100% correlation nonetheless.
