    Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

    I wish everyone the best and hope they get GC very soon.

    Congrats buddy ! Its quite ironic that there are some people who filed a few months here or there from your PD in 2000/2001 and are still waiting for their GC and I know a few people who filed for GC in 2003/2004 and got it in 2005.

    The odds of getting lucky with USCIS are worse than hitting the jackpot .

    Well said. They have their own self interests in their mind...

    Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)

    Why can't we simultaneously have webfaxes + letters + phone calls + sit-ins + flower mailing + writing to newspapers etc. etc.?

    The reason is that whatever the "action item" - it's more or less the same 500people who come forward.

    Having said that - there is no stopping members to lead and motivate other members to join in an aciton item that they can "sell" to those other members.

    Why do we need this thing?
    Let him say what he want to . This pettion against him will not accomplish anything. He is not a government official. Albeit, if you want you can sue him.
    So guys focus please.
    Please channel your energy, we need it now more than ever now. Noises like Lou or O'reilly will always be there. They are good source of revenue for these news channels so most likely ur pettion will fall on deaf ears. Moreover, these guys can use these things against us and we cannot afford to open several fronts at this time. SO Ignore them.


    I plan to send this petition to all senior executives of Time Warner Inc by Priority Mail and Fax. CNN is a fully owned subsidiary of Time Warner Inc.

    I guess I may fall victim of FBI background check. Even though, my priority date is not current yet but, it should be next couple of months based on recent EB-2 movement. We had our AOS interview last Nov and IO told us that she is going to initiate another Background check as original BC is more than two years old. In the end of April, I made an Infopass appointment out of curiosity because Background check use to be a major source of delay for many people. Service Rep on window told me that my Background check has not come back yet.. It was almost 5 months since it was ordered.. She did not elaborate on why was it pending.. She asked me couple of weird question which did not make any sense to me. I have schedule another appointment in next couple of days to find out where do I stand. I would like to keep my expectations in check as pending BC can delay it even when priority dates are current.
    Can anyone on forum please provide some info on what can be done if Background check is pending over 180 days.. I can make a request to my Congressmen and ask for their help... Any suggestions will be greatly appreciated..

The claim that the undocumented do not have rights is one propagated by Lou Dobbs and other anti-immigrationists. This is why it is possible for an undocumented worker to file a discrimination complaint with the EEOC and win for example.

    You have to see my quote from the context of immigration. I never said illegal immigrants do not have any rights. Human rights are across the board. Every nation must follow these standards. Illegal immigrants can not sneak into a country and then demand that they should be given citizenship.

    Regarding undocumented workers filing with EEOC, please quote me few cases like that. I doubt if it is ever possible. In my personal opinion, when such workers are subject to deportation when found, where is the foundation in that case? Are you suggesting that non-citizens can apply for jobs in defence and aviation and complain to EEOC if rejected?

    I read few articles about (undocumented) women being exploited by the employers and USCIS/DOL treated these women as victims. That angle was more of human trafficking, not employee-employer relations.

    Hey that is not fair, you shouldn't be able to change the background because you will earn votes for it and not for the iPod design... it interfeers.

    You can change your background if they want too... mine took like 3 seconds to make. People know we're voting for skins, not backgrounds.

    Steady march!, not fast march!! ;) I am very hopeful of the dates moving past mid 2002 for FY 2009. (which is about 8 months movement from now, and I think that is very possible).


    I am thinking we have about 5-6% representation for the earlier years on this poll? What is everyone's estimate on the representation??

    abt 5%. I think people from 2001/02/03 must have got so much frustrated that very few of them even check the visa dates, forget about checking IV regularly.

    How do you know that all the unused visas go to EB3 before go to EB2?

    That is the way the USCIS is interpreting the laws and actually doing it that way...There are two different caps applied to you....The EB2 cap of wharever numbers available and the country cap of 7% for all of china EB+FB combined together.......It is true that there are more EB2 numbers available...But as the country quota for CHINA/India is over they are flowing to EB3 ROW instead of flowing horizontally to EB2 china....There is a big discussion about how this flow occurs and if it is fair or not...The title of that thread is 'Unused visas' Reading that would be helpful to you...


    Even if the immigration reform happens, will it take effect next year or sometime later?
    Frankly donot know....Last year when they passed 2611 they had put conditions in it to delay the implementation..They can put delay again...That is possible....
    How come my PD can become current immediately once the immigration reform happens?
    The total number of visa available would increase with the immigration reform...There would be enough unused so that you would get some...

    Very well said.

    I totally agree with you.

    I really hate those people , who get fraudulent H1B's and GC's through Fraud Desi Consultants. I really wish USCIS to investigate approved GC Cases and deny them , if found a fraud.

    This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.

    Few points:

    1) having gc is a privilege not a right.

    2) US has every right to choose whom they want to have in their country.

    3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.

    4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)

    5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.

    Wake up friends, you have options. Don't let your life depend on you application status.

    Armed with bipartisan support, an Arizona congressman is moving ahead with legislation that could solve a series of illegal immigration issues.

    Rep. Raul Grijalva said the measures will be introduced soon and would provide expedited citizenship for active duty military members who are not U.S. citizens, and permanent resident status for their families.

    House Resolution 6020 would help some of the more than 45,000 noncitizens serving in the U.S. military as of March 2007, said Grijalva, a southern Arizona Democrat.

    ``Some families fear immediate deportation if their noncitizen soldier is killed on active duty,'' he said.

    The bill would permit family members of such soldiers to become lawful permanent residents.

    A second bill calls for basic health care for detained immigrants.

    House Resolution 5950 would set medical care standards for immigrant detainees.

    The secretary of the U.S. Department of Health Services would be required to establish procedures for the timely and effective delivery of health care to detainees and to report the deaths of detainees to the agency and Congress. It would require any necessary medications be provided upon detention.

    Grijalva may not he done yet. The congressman said he is considering co-sponsoring two more immigration bills that have bipartisan support.

    One eliminates the per country limits on foreign workers who can obtain employment-based visas to work in the United States.

    The second would allow about 12,000 masters or doctorate-level graduates of U.S. colleges each year who are noncitizens to obtain green cards to work in science, technology, engineering and math.

    Q-1 (07//19/2007): I filed I-485 application on July 2, 2007, but have yet to receive either rejection or receipt notice. Will this application be fee'd in under the reversal of the USCIS decision?

    A-1: The DOS withdrew any changes to the original July VB and assumedly visa number is current in July 2007 for any categories other than "other worker." Accordingly, the 485 application which you submitted on July 2 cannot be rejected by the USCIS at this point. The USCIS is likely to fee in your application and soon issue the Receipt Notice.
