Hi Experts,
The question i've is:
I heard from my Immigration Lawyer that,from November 01, 2008, any person who works in Information Technology (IT) and who has Advanced Degree from USA like Master's is eligible for EB3 Category only and not EB2 category. Please confirm if the above statement is true or not.

You are way more qualified than me. I only have 2 masters, research work, research papers. My attorney was able to get my EB1 approved without sponsorship. You will definitely get EB1

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.

Just think how it feels to be waiting for receipt notices, knowing people who filed in late June are still getting them (and only a couple of July 2nd filers so far)and also knowing that if something is wrong with ur application, its going to take years before you can apply again....and compare it to the additional 2 months u r going to wait for ur EAD/AP

Someone needs to highlight the points of difference between legals and illegals regarding how they are being treated

Yes, this is not falling in place with their processing dates. But i think, you should be getting your approval any time. May be, have your attorney contact Vermont center for inquiry. Or you can call the customer service directly.
I filed for H-1 extension on Aug 23rd. Still not approved. Dont know why they have dates at Oct.......

Hi Gurus - Can someone enlighten why lawyers reco. not to inform USCIS about AC21 and wait for RFE?
Also does anyone knows how one can get back on h1b after invoking AC21? If AOS is denied how to get h1b again? (if not exhausted 6 year of h1b)

IV is the only group that is trying something for EB gc's!!! If you don't agree with IV mission statement - least you can do is SHUT UP! If you have other selfish agenda's take them some place else... don't use IV as a platform to segregate a group.
(In my personal opinion... IV should BAN anyone who suggests anything that breaks this group down! Enough is ENOUGH!)

She should have tried through the emergency quota/appoinment to get her stamping.. Death in immediate family is a accepted for this and I know a colleague you had to go for India for the very same reason, death in the family and returned back after getting his stamping. Got his appointment through EQ. If you fear to get stamped in India, then you can blame the appointment to be 4 months away, etc.. etc...
The article posted is touching, but out lives are not that bad .. We are far more better and we do have a good life.
I do not think one would not go to India just because he/she is scared to get a stamp in India. The loss of someone dear to you can overcome any such fears one might have (for me atleast thats applicable).

I got this RFE more than an year back. The birth certificate that I had provided did not have my name and just said "male child". So I had to provide the following secondary information-
1) An affidavit from my grand parents. Two different ones saying that they were present at the time of my birth.
2) Affidavit from the Doctor that he was the person who performed the operation.
3) Government issued Ids like driving license showing complete name with a picture.
Hope this information helps.

If the person gets the visa stamped on the passport at the US consulate abroad, I do not see any problems re-entering.
AP is only optional. You can always get a valid US visa stamp based on the approved petition and use the H-1 visa stamp to re-enter.

There could be a problem at Point of Entry if the officer notices the exit date before the approval of AP. I think for you to be able to use AP to enter it should be approved prior to your exit out of the country. You might want to consult an attorney or USCIS on this. If the IO at POE stops them there is nothing you can do. So be very careful on what you want to do here.

They were suicide missions to bomb American targets (like Pearl Harbor) knowing very well they will not come back alive. They would crash their planes into enemy targets laden with a lot of explosives.
Go figure!

This is something that's doable without legislation. It would be done for employment based visas.
I've been reading the posts all day since yesterday. The most plausible "PERMANENT SOLUTION" has to be this. Please read the msg from IV
1. No change in July bulletin
2. No change in August bulletin
3. Well in that case it has to be this. It would be least controversial.
This however would be a good solution for the over-subscribed countries, and bad news for the other countries...

If you are on H1 and switch to another H1- you do not need to worry about Cap
If you are on H1 and switch to EAD- you have relinquished your H1.Whenever you wish to resume your H1- at that time you will go against the Cap.

I know people on h1 with consulting companies did better than those who got stuck with one permanent job.Stale career , stale pay and so on...
Do your best and make most of h1b.
Switched from one FTE to another FTE where I was probably the only H1B FTE working with a bunch of contractors and company would not file labor until first appraisal was done i.e. 3 months. By the time the slow-arse attorney completed the PERM requirements it was already September end. It's just frickin crazy,I know, stupidity on my part too in changing jobs. But opportunity knocks on the door once and was not unfortunately in sync with the idiosyncrasies of CIS and DOS. Hindsight is always 20/20 and no point whining. But having to constantly look at the lucky guys makes me say "Kick the H1Bs out; they took my greencard" :D

Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)
It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.
I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!
Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!
Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

Funds, There are more ideas than funds. For every new campaign, plan, we need funds. So it is an ever needed commodity. We can do a lot and lobby effectively, we just need more funds, plain and simple. Inspite of several hundreds contributing, it is not enough. Remember IV is a non-profit, so every penny is accounted for. People handling money (core IV) are sincere, honest hardworking people on work-visas, they have much to lose from not being accountable. And the most important thing is, please take a look at these hard-working IV CORE PEOPLE, please. Some of them have put thousands of dollars (I mean 5 and ten thousand) into this effort. I am not counting personal expenses, travelling to DC, lost work hours etc.
So your $100 at the bowling arena, or $50 at dinner or $35 bouquet wont get you much farther, but your recurring contribution to IV will.
