Unless it was a felony that requires certain jail-time or something it's not always counted against you.. remember .. purpose is not to exclude shop-lifters.. they got plenty of those in Canada but rather identify and filter out security hazards.. you might need in person interview.. but it should be alright.. I know even US immigration allows folks like that.. so can't imagine Canada being more stringent..

The visa in my passport expired 4/2006.
Currently I am on my 7th year (which I do not have stamp for since I did not leave the country in a while) which ends 4/2007.
I just applied for my 3 year extension (8th, 9th 10th) which I hope to get approved in Feb before I leave.

Also, you don't have a date gap in your visa in the passport. I-94 expires 04/2007 and have a new 797 from 05/2007. So I think you are good. I think we physically need to go to the adjudication center...wait at the gate do a bhuk hartaal or the sort to get our cases cleared.
I am pretty positive that SR/Infopass/Congressman/Senator are coincidences....it should not work all the time otherwise you and I would have been approved too...
I am told different things everytime I call them .....
It is hopeless since I am sure the October bulletin will put the EB-2I for November to U or early 2000s as there are hardly any visa numbers per the country cap quota...and then you need to wait till Sept 2010 for any luck.....

Actions speak louder than words... Lou Dobbs says Microsoft has waged war against the American middleclass by taking the company to Canada. But that hasn't stopped the company from starting a development center in Canada, nor has the company cared to answer Lou Dobbs in a press release or anything. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).
There are a few lawyers who say this is possible, but the majority consensus is that using EAD with even one employer invalidates your H1.
Dont worry about a months salary at this point. If you want to maintain H1, try to delay the H1 transfer a bit so that you complete as much of 180 days as possible with your current employer.

My checks were cashed today.I found the LIN numbers on the back and checked the online case status.It says, we received your application for I-485 on sept 18th.:eek:

Can you let us know know why you cudn't get it corrected at the CBP? Its clearly a mistake by the POE officer. Try other CBPs till you succeed. thats the best option you have. I've done it myself. First time, when I called them to get an appointment they said it can't be done. I called them again and got an appointment without any problem (obviously it was somebody else who attended the phone). Went in person and explained it clearly and the officer accepted the mistake and apologized on behalf of the POE Officer. He gave me a new I-94 and struck out the new number and wrote the old I94# on it. He also updated it in the system.
So, please give it a try before trying out other options. HTH!

Guys,
The reality is that we are just being played upon by the companies and the US govt regarding green cards. Employers know that we are not going to budge from our jobs to maintain the coveted priority date and the government is in no big hurry to reform the system as they can collect taxes from us without being accountable to us.
I think Democrats are also going to drag the immigration issue as seen by the article below :

I do not mean to doubt IV, but the writing is on the wall that our lobbying efforts are not going to go too far.
For all of you single people out there, the only fastest option is to marry a US girl/guy. For all those who are married, the choices are simple, forget the American dream and adopt a Canadian or Australian dream or endure the uncertainty of a green card application.
I have reached the conclusion that I cannot bear this uncertainty any more and therefore, I am pursuing other options. Ciao...Good luck to all those waiting for a GC!

The whole experience of the rally was really great, meeting the staffs of Congressmen/Congresswomen, IV core team, other volunteers and members, hearing the speeches of Congressmen and being a volunteer.
Rally was well organized and volunteers tirelessly worked all three days. Me and my wife are really proud for being part of this historic event and also proud for the participation of so many fellow CA members.
It would have been great if members from neighboring states have attended in big way.
