Let me preface this by stating that I have not yet shot with a D70, however I have heard very good things about it...particularly for it's price. IMHO, the best test of a camera is done in the field. By in "in the field", I mean does it allow you to do what you want it to do. A DSLR has a learning curve if you're coming from a P&S. Once you begin to master a DSLR, theimage quality bill be much better, and you also have much greater ability for creativity. If you want a D70, I'd take the info you've read regarding various issues with a grain of salt. Buy one from a reputable dealer that allows returns if it does'nt meet your expectations.
After deciding to buy the Nikon D70 I began to read a number of posts to the pReview forum that had D70 owners citing backfocusing problems with their new D70s. All resorted to sending their cameras to the Nikon Service Center for repair. All reported at least some measure of correction but some indicated they could not achieve precise focus within the DOF for each of the Nikon compatible lenses they owned and are useable with the D70.
I own two Sonys (the F707 and the V1). Both, in my view achieve remarkable clarity, color and brightness right out of the box. AF on both is, again in my view, is extraordinary. So, I would be very disappointed if I were to spend 1500 or more bucks (with some accessories) to arrive at inferior imagery.
It is possible what I am reading is the view of purists who are able to "see" focus flaws that the more casual, but still demanding, amateur photogs would dismiss?
Has anyone out there had experience with the backfocusing problem to which I refer?

According to my employer, he is going to the Senators office tomorrow to talk to them regarding my case. Got an appointment some time this week to see them on Friday. I dont know how far this is true. They already wrote a letter to them 2 weeks back. This is what my employer says. But I dont know whether he actually contacted them or not. He said he will give me further info on monday. I have to wait and see what he comes up with ( truth or some other new story) on Monday. Then I might decide to move on to a diff employer if nothing works out.

Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?
Others, please feel free to add to the list of questions.
Thanks

I think the original question could be rephrased as follows:
Will I get an FP notice if my PD is not current?
Would someone answer this question, please?

Hello Kiran,
:) Thank you! Yes, I personally have always been a supporter of FIFO for permanent residency and I empathize with all who are waiting much much longer than me. That's why I said that I wish there are more IOs like the one who is working on my case.
Good luck to all of us and let's keep IV strong!

I listen to this guy everyday on my way back from work. He is a very unpredictable guy. I haven't heard him say anything for or against Indians. However he is very anti-latino and anti-chinese. He even doesn't want the chinese students coming here. He has said several times that this country is being run over by legal and illegal immigrants.
I have thought about calling him several times but firstly he is difficult to get through to, secondly he may not comprehend that legal immigration is beneficial in more ways than he ever imagined. He is a very egoistic person and insults people who don't agree with his ideas. He is also jealous of others (competitors). He openly said that he took pleasure in Rush Limbaugh's arrest recently on prescription fraud. He declared that it is the end of Rush's radio show.
Personally I don't think we are going to gain much talking to him. However I have a suggestion. We can try calling him and just ask his opinion about high skilled legal immigration without mentioning a word about who you are, or about IV, or illegal immigration (which might irritate him).

Background : EB2 India PERM applied in Oct'08.PERM RFE Audit notice received on Apr '09 and replied immediately by the lawyer. Currently as per iCert labor website Audit cases being processed as of 07/31/2010 are PD July 2008. My H1B six year completes on Jan 2012.
Question :
- When do I realistically expect any decision on my PERM audit?
- Should I apply for fresh PERM Labor in order to meet the 365 days prior labor applied rule for H1 extensions or should I wait for the audit to be decided? My spouse has EB2-I PD OCT '07 with 140 approved ..waiting to file 485.
- In case I decide to wait, what will be my status if the pending PERM currently under audit filed gets denied? What are my options for further H1 extensions in that situation?
- If advised, when should I plan to file my fresh PERM labor? Given that a RIF took place at my employer at end of May 2010, per my understanding there is a six month wait period after RIF to file for PERM labor. Hence, can I file PERM earliest by the end of Nov, 2010.Am I correct? Will I meet Jan 2011 deadline o file fresh PERM?
-What are your overall suggestions in my case?
Thanks for your help!

I saw that as well. Thanks for the pointer. On the form 129 Part 2, Question 4 it asks for prior receipt number. Would the current receipt number and the old I 94 suffice? I dont see her H1 being approved ahead of her H4 as there will be a deluge of applications on Apr 1st.

Thanks grupak! I was able to use PTO with my employer..
Is it possible to start working for the New employer (After filing H1B Transfer and getting the receipt) when on a PTO with current employer? Is this Legal to do so?
If first option is NOT legal, then can i have a GAP of 3 days (without Pay) between current employer (Last date) and new employment start date?
Thanks!!
PTO is a new one for me. Paid Time Off??
You can work with the new employer while H1B is pending, for 240 days as far as I know. There is premium processing if H1B doesn't come on time.
3 days without pay is not a gap in employment if the employer-employee relationship is maintained. Don't worry too much. Even in normal circumstances, it takes a few days to relocate.

The approval of h1 will not invalidate H4 visa. The usage of h1 visa invalidates H4 visa.
if you have h1 approved and don't join the company, then your h4 remains intact. Once you join a company on h1, you will fill out i-9 form, which informs the concerend authorities about your status change.
All these are correct. But the main issue is tv25's spouse H1 is denied and the reason is "misrepresentation". So, its a serious charge. And if its on the company's side that put any bogus documentation then he is fine...but if its on his wife's documentation then he ought to be worried cause it may/may not(only an attorney can answer) affects his I-484 case...his credibility is at stake now.
TV25, Ron Gotcher is a good attorney and this is his web site http://www.imminfo.com/...I don't know him personally but, he is an American and he replies to most of the queries in his forum, and with very good explanation. Ask him...that's my suggestion...

Thanks Paskal!
This is exactly the kind of communication we need from the core.
I concur with you all the way, if you look at this country's political history, all major bills passed through the election year. We have hope, this bill will pass. So please lets all remain positive and strive our efforts for our goals.
Also with the PM of INDIA coming this week and the talks on 123 agreement, I am positive something good is coming to all of us. This agreement will be the first important treaty between US & India.
Good luck to all IV members, thanks for all your contribution and help so for, lets keep positivity and our efforts aligned.

Thanks GCPlease. I will wait for 15 days and then call USCIS regarding the RFE.
wait for 15 days since USCIS said they sent you the rfe. After that you can call uscis at the # they have in the EAD Receipt they sent you, and you can open a Service Request for non delivery of the RFE. There is a 15 day rule. if you call earlier, they are not gonna entertain you. I got my RFE after 3 days I opened the SR.
But call immediately after the 15 days because the time limit for you to send the rfe is 33 days and this clock starts from the time they say they have sent you the rfe (which you may have recived in an email notification or the online status). They did not extend this time period for me due to non-delivey.
The RFE they sent had the address we need to send the response. I think it was a different address.
The above said information is based on my experience. It may be be different with each case. you know how uscis is. just use it as a guideline.

A friend told me about the E category visa for Australian nationals. Is this true?
According to him, if you become an Australian national, you can use the E-visa.
Has anyone migrated to Australia and returned to US successfully on a E-visa?
Has anyone also applied successfully for a green card on a E-visa?
How long does it take to get Australian nationality?

Has anyone contacted the ACLU of Texas on this? This is unrelated but they have been active on such fronts:
http://www.aclu.org/immigrants/discrim/36876prs20080922.html
ACLU site is a good one. It has tips on how to campaign, how to write letters to your representative etc
Browsing this site would be quite useful for IV members. Maybe IV should have something similar on this site.
