Going to Initial Review after approval is scary but normal when you get done FP after approval. I think if you have the I-797 approval then there is nothing to worry about. If you follow a thread in tracki*t you will know that couple of people also got similar status change after FP.

There is no harm in trying different possibilities. Media is a good option.Also,
contacting indian ministers and government is not a bad idea at all. They may be able to help us ! it is better to try , rather than doing nothing !

Theres a butt load of cases in this similar situation including myself where a case was transferred to another service center. It appears they can't find or update fingerprints for such cases. Its a shame but another glitch from USCIS

I think my situation is a little complicated as follow: while I am still in F1 status and visa (2.5 months before graduation), one company filed I-140 petition for me on EB3(May. 2006), I applied for OPT EAD card and got it approved on Sep, 2006. Then my previous I-140 got approved on Dec. 2006. And now I am using my OPT EAD working in another company, and will start my H1B application with the current company soon.
I am wondering if the previous I-140 application with previous company affects my current H1B application with my current company? Since it was filed while I was in F1 status(even before OPT EAD approval), some said it is not allowed...
I am really concerned about this now... please advise ..

Guys, chill out! Hammer's concerns are genuine...but a bit misplaced.
H1B visas democratized the American dream. Initially, American Dream was available only to people who came to US to do Masters and people who were hired in India directly by American companies for jobs in US. The second option was extremely rare.
People who didnt fall under the above two category could have invariably come through a Body shopper who democratized and socialized the American dream. They made millions not only by being at the right place at the right time but also due to some questionable practices. Those questionable practices are the one that has lead to what we witness now.
Remember one thing, most of the people on H1B (excluding most masters and all direct hires) would have started their US career with a Body shopper (includes both Desi and other firms like Wipro, TCS, Infy, Satyam etc)
We need to look BOTH at our current situation and the path that we traveled to reach there.

How about this education for EB2
10th + 3 year Polytechnic (Electronics) + 3 years B.E (Computer Science & Engineering) Degree = 16 years of education
+
8 Years IT Experiance
I have same education only difference is Mechanical engineering.My 140 was approved in EB2.

It is not justified, if people don't know what USCIS is referring into. All big lawyers have its subscription. So they guide their clients in a proper way. OP's lawyer screwed him to file in EB2. Even EB3 also difficult, if the advt. is for a US equivalent degree requirement. May be put advt. for a associate degree or non-degree positions with some college studies. For EB3 candidates did not require a degree, if the position advt. says so. But prepare for a tons of applications for that position.

Would 3 yrs bachelors and 3 yrs masters (MCA) with 10 + yrs of experience qualify for EB2? Is there anyway we can check in that EDGE database?

AT the POE the visa officer will know where you are. Apart from regualr list of docs for h4 stamping I dont think any other doc is required! But please verify with your attorney.

I am one of the frustrated ones under EB-3 (India) with a PD of Jul 2003. My case is as follows:
I had 3.5 years of experience + MBA from India when I joined the current Job in 2001.
I applied for my GC in 2003 and the lawyer said since my MBA was not relevant for the current job (software engineer) and since my experience before the current job was less than 5 years, I should apply EB-3.
Currently, I have 11 years of experience (out of which 7.5 is with the current employer from whom I have applied for GC) and I have moved to Business Development that uses my MBA quals.
Can I change to EB-2? What do I need to do? What are the risks?
Any/all pointers will be appreciated

Do they have a signature authorization from you? If not , they can not send a G-28 that is not signed by YOU !
even my employer didnt allow us to file saying, if employee files, FBI will get mad thinking it has toxics in it :D :D :D
trust me thats what they told me..dunno what he thinks..:) :)
but the point is I sent my docs to my employer and I didnt include any G-28 in it..which means we signed as we prepared all docs..
Now can they attach G-28 and introduce themselves as representatives and swallow all receipts???
