If in 485 denial it is due to ability to pay and they state so in 485 denial and you were paid labor wage from priority date until you left and were eligible for ac21 then the denial would not have been in error and you would be fine.

H1B visa CAN BE and IS given to teachers. That poster may have had the problem similar to mine and that is having spent 6 yrs in H4, she was ineligible for H1. Let me remind everyone that decoupling of H1/H4 time happened only 2 months ago. Therefore, if the lady in question already possess Bachelor degree (as min requirement for H1) and is otherwise certifiable I dont see a problem for transfer to H1 .
the only problem may be in finding a school district willing to file H1 WELL in advance and accepting the fact that she cannot start working on SEP 1st (when the new school year starts) but OCT 1st.

EB3 I is still very unfortunate... I guess this is how the melting pot works... correct me if I am wrong.
Out of 140K Visas 7%= 9800 is assigned to India (All Categories)
Out of 9800 - First EB1 then left over EB2 and Then leftover to EB3 :(
From over all left over of 140K - First EB1 then left over EB2 and Then leftover to EB3 (all other countries) - Left over (EB3 China) - Left over to (EB3 India) :(
EB3 India is lowest on the FOOD Chain!!!
EB3 India is not unlucky but thats the default category for any one to apply when they or job doesn't let them go for Eb1/2.
So the obvious reason is:
when we have brand new lot of 85K H1s most of them apply for Eb3, and big chuck is Indian (no 7% cap here), but regardless of category, if 85k applies for GC, with one dependent it counts 130k.
And for GC allocation we have country cap which is ONLY 7% when we have 70% applicants. Do the math, 85000*.7*2= 119000 applicants for GC from India each year and they are entitled for 140000*.07=9800 and now lets say with all favors from ROW and EB1 we got double say about 20,000 still there is a back log of about 100K each year.
Thats assuming everybody applies for GC out of 85K H1 stock.
Based on this I don't see EB3 to become FIFO or backlogless because the system is not balanced,
# of ppl coming on H1 each year * xfactor = #of GC given to EB each year

b) you don't do any benefit whatsoever to EB-3 India/China
c) you only benefit EB-2 India/China (at the expense of EB-3 ROW)
So, you make no difference whatsoever to huge number of EB-applicants (b), and you benefit (c) at the expense of (a).
I hope you see that this is not a good solution for the majority of EB-applicants. With this kind of cannibalization, the only people who have any incentive to stay with IV would be EB-2 India/China.
We have to work to increase the size of the pie here, and not engage in a zero sum game.

Couldn't disagree more with kaisersose or guns. GC system as it exists is rubbish and ugly in many ways- but as bad as it is that's what's legal and in place now so we have to go thru that and if possible, make it better along the way appealing to the saner elements of the society. Brain drain is tricky - you guys are honest enough to admit to not having it so theres clearly no drain there but other programmers will disagree. Some history lesson's also in order - will do it later. I was transferred to a IO yesterday. She was rude, told me that I should not be calling since they responsed to the first SR that was opened by my attorney on 09/01.
Not sure if you read the other thread, but I have got 2 responses from USCIS so far - one for inquiry that was sent when I took the Infopass and the other one that was opened by my attorney.
Response that I got for inquiry from my Infopass was " Based on the additional documentation provided, your case qualifies for expedited processing. You should hear back from us in 60 days. If you do not hear back in 60 days, please call us back".
I havent provided any documentation to them in the last 2 years, after my FP was done in September 2007.
So when I talked to the IO, she read out that message to me and in a subtle way asked me "What part of that message do you not get"?? I was trying to explain the situation to her, and before I could finish - she said "Sir, I got to move on and take other calls, please dont call back before November 15th".
And then she said the part that chuckles me the most - Sir, is there anything else you would like to me repeat, or do you have any other questions.....??
Hell yeah, I only have one question - when will I get the magic email?? :o

Just curious. Why do you claim ROW is receiving preferential treatment over India when all the countries get the same upper limit of the visas. Now if the Indians ask for more visas just because there are more Indians asking for green cards, wouldn't that be preferential treatment? :)

You are in the category getting preferential treatment, so you oppose any change, you "create" arguements that you were "promised" a system when you came, and thus any change to the system, before you get your green card would be WRONG and UNFAIR. So you should continue to get that PREFERENTIAL TREATMENT. And PREFERENTIAL TREATMENT to you is NOT WRONG AND UNFAIR. Right?
