So does that mean that if one's I-485 is rejected (Has no luck with MTR either) - Then he cannot continue after his current H1-B expires (After 0 to 3 years)?
Going back to his home country is the only option?
RXSimha, the best advice you can take is to talk to an immigration lawyer. Nobody that has posted here has stated any facts, only interpretations. If you wish to learn more follow this thread:

Make an account and ask your question to Ron, which has already been answered multiple times. He is an immigration attorney. But do not stop there. Confirm all information with multiple immigration attorneys of your preference at your discretion.
Good luck.

Well what happened here in US when Enron and all these financial giant failure.
Well Said GCA, I think it is another good test for Indian government to their guts and do justice (may sound Naive but ...) for folks who are effecting by this. They should not loose this opportunity.
GC quota should be based on skillset(1,2,3), not solely based on salary.(remeber, we are talking about future salary here).
we do have it : EB1/EB2/EB3. See EB1 is exploited by 'lot of' people (due to legal loophole) -these people have 4-5 yrs. total work-exp. & get half the salaries & are only 50% useful to US economy than tons of people stuck in eb2 & eb3.
(i know - it is all useless discussion ; won't result in anything).

Hey folks,
The proposed bill to give green card to PhDS does not include all the PhDs. PhDs listed as STEM(Science engineering technology majors) are only eligible through this bill in current form. Graduates from pharmacy, medicine, veterinary medicine, animal science are not listed as STEM. I am sure there are many more majors not listed as STEM. I think we should write a letter to congressmen about this anomaly. And I encourage non STEM PhDs to represent their concern so that we can unite and represent our concerns to the congress men. immigrtion service department has listed the subject codes fall under STEM.
You have to browse through the following link to see code for your major. http://nces.ed.gov/pubs2002/cip2000/ciplist.asp.
once you know the code for your major you can go to http://www.ice.gov/sevis/stemlist.htm to check weather your program is listed there as STEM.
good luck

I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.
http://immigration-information.com/forums/showthread.php?p=20233#post20233
He says that Eb2 India will retrogress to 2003 or 2004.
This is my opinion. TSC 485 processing time is July 17,2008. NSC 485 processing cut off date is July 28th, 2008. I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.
Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.
yes. there is a possibility of some retrogression for EB2 India/China in the comming bulletins. But that is just for few months and it might be a mild retrogression as long as there is horizontal fall outs of spill over visas.

I applied my first H1B extension through my company in June 2008. On 11th Feb, I received REF. I am very much tense about it. Since I am out of project. I got cleared my I 140 with this company in July 2008.
I applied H1B transfer(Normal process) also in October 2008 to other company . This one is still pending.
I am very much tense about my status. Please suggest me what to do?
Is it better to answer to RFE for first company?
or
Can I do PP with second company? or else any better thing?
Thanks
Vidya
months you are out of projects? if its more than 60 days then even though if you transfer to other company they will ask for pay stubs..... which you may/may not have......

If you get H1 transfer with sponsorship for GC, you can port your old PD to the new I-140 petition. Better to apply for 3-year extension now itself, if you think there will be layoffs. This gives you sufficient time to apply for perm LC/I-140.

So I am in some real mess ....
I married to a gal in 2007 during my visit to my home country but it did not work out b/w her and me due to some family reasons. (Not divorced just separated)
I came back to US in 2008 and applied for 485. My green card got approved and now my wife is in my home country and I am in US.
Now my wife and I have reconciled and I want to bring her to US.
Can I apply for her Green card and bring back to US ASAP w/o waiting for 5 years as I married before approval of my GC. I can get papers from my home country showing that I got married way before my GC approval.
I did not show at any stage in GC application that I was ever married. I thought the marriage is gone so why show it and now it could hurt me. I even dont remember if there was any question regarding marital status on 485 application.
Please help me other wise I would just have to cancel my GC and go back to H1 to bring my wife here. I cant leave her any more with our stupid relatives who might again break our marriage.
Please help , I am very desperate.

Do not give up your green card. You must explore all options before doing that. Your best chance will be to get her here on a F-1 visa. If she is qualified, H1-B is appropriate but these days it's not easy to get H1-B. As far as i know, once your green card is approved you may not be able to add your spouse. Anyways, it would be best to consult an attorney like murthy and if possible use their services. They know the rules and most probably USCIS knows murthy too.

Let us say I accumulate 40 points and return to India for good. Do I still get Social Security in India if -
1. I am a US Citizen living in India?
2. If I am a GC holder living in India?
3. I am neither a US citizen nor a GC holder living in India?
Any helpful links are appreciated. I have tried to calculate benefits using Social Security benefits calculator, but if you key in residence outside USA and non-citizen, it does not work...
With citizens of India, it is full penson benefits, what ever it is (earned based on contributions). You don't get medicare type of thing.
For citizens of countries like Canada, it is limited by windfall limits. People who worked in both US and Canada become elligible for too much retirement benefits and it is curtailed by limits.
So in nutshell, any treaty may worsen benefits of 10 or 10+ Social Security Contributers.

This is a million dollars question on everybody's mind. Although the books says you can, I bet no body will take the risk.
Nobody can predict when July filer will get AP too.
There is a good chance I am taking this risk. But if there is any hope I will wait. Contrary to that if there is no hope I don't want to keep waiting until July next year for AP.

1. What is the use of a non-paying member?
-- probably when we need to send out the webfaxes.
What is lost if a non-paying member leaves?
a group of 8000 members always has more power than a group of 200 members..
I did not follow the I-485 filing debate; it was sickening. I made a one time contribution. I don't think I am included in the 220 count. I think there are very few members who have made a one time payment recently and are not included in 220.
I think, the count 220 includes only recurring payments that started this month. Some persons paid before this count started.
The only useful thing we can do is to work on contributions. It is hard to figure out reasons why persons are not paying. I think it will be useful if we guess all possible reasons and work on all of them.
We should not insult any non-paying member or anyone for that matter. I still want to know
