Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.
But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.
It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.
I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.
Is there anyone else in the same boat? How long does it take for MTR to get processed?

Guess what the " hard core republican ", corporate CEO loving, capitalist champion is now the warrior for the middle class and a critic of the current administration.

I dislike his show, i do not rescept his perspective (because it is mostly based on incorrect or false information) and i sincerely believe that he is a worthless parrot.
Time to act - we must begin countering him.

Understood. Now you want all H1 L1 B1 everything to be stopped. So lets vote only for EAD/AP/GC till you get your GC. After that US should stop GC also, right? (but ofcourse, naturalization still should remain open for a few more years).
If one person can work for your job at $8/hr, and you are charging $100/hr, market would adjust itself to $8/hr (for a moment forget about who does this $8/hr, it can be a high-school kid, or anybody).The only reason why somebody blames that $8/hr kid for loosing his job is because he "thinks" he is "superior" to that kid. There are many situations where companies decide to retain "fresh college grads" and layoff "senior experienced" persons, to save money.
Don't take me wrong, but I also think the L1 is mis-used a bit. But I personally think the mis-usage comes from other factors (like H1 unavailability, employer prefer L1 because employee cannot change to another employer in L1, other H1 restrictions) etc..

But So far I have seen companies put people only at the client place and their salary is starting at 32K and they are put up at extended staty, asked to share the cab or car. They bought the cheap indian insurance and no doctor is accepting here. So the employee needs to pay from his pocket and need to collect it later. Because of this guys are not even going to the hospital.

So our common goal is to fix the broken system, remove the employer's undue advantage over the employee. No matter if they are MNC or desi consulting companies. Why the employee is tied to the employer when there is the need/demand for the skill set. Thats the only thing which is driving down the wages.

Looking at the wait times for current applicants, my wait time was nothing.
I hope things improve for better. There is no reason why one has wait for 5+ years to become permanent resident.

I got the letter.
As of 10:30 AM PST (Thursday), I have responsed to all requests for Sample letter, details of officer at TSC and steps to reach IO at TSC.
If you have not received an email from me, please send me a message again. It's been almost impossible to keep up with all the requests I have received since last night.
Any requests that I get after 10:30 AM PST, I will respond to them tonight.

The hardships we have chosen to enter united states and struggle here is of our own choice. It was an option. You can come to office at 9:00AM and leave by 6:00PM. No body asks you to stay late unless you work for a consultant. No body asks you to relocate unless you again work for a consultant.
You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.
We all have options and it depends what you choose.
Just because few centuries ago someone entered this promised land just like that, you can't expect that to be existing now or atleast a modified version of it now.
Again, i believe the immigration system can be improved only if senators can taken into confidence about our hardships. Striking the way illegal mexicans did and or raising slogans like 'immigration is a right and not a privillege' may play against us.

Lou Dobbs was in Orange County this weekend as a Keynote speaker at the The World Affairs Council of Orange County. He launched into his usual vitriolic diatribe, there were many business leaders at the forum and he ended up polarizing the crowd. Some felt that he is all talk with no practical real life experience managing companies, his ideas are over the top and cannot be implemented. He never ran or lead a fortune 500 company or held a major political office, yet he critiqued the very organizations who sponsored tables for this dinner. A few did get carried away by his speech, i have to say that the crowd at the back was cheering wildly for him while the executives in the front were subduded. BTW this person with socialist leanings has hefty appearance fees.
We would be better off not wasting our time on him or rebutting his indirect accusations, he is playing to his crowd. We should play to ours.

It is completely unpredictable. Actually when you file I485 USCIS does not process FIFO(They are supposed to). For example there are 10k gc are left for the year. First they will process the applications which are cleared FP based on PD and receipt date. Always risk is there when filing without marriage. You are safe till USCIS starts process your application. When they take your application for processing then you cannot add your spouse. Also if CIR decides to process backlogs faster then also you will be in problem. Best option is if your marriage is already fixed do it within 3 months and file GC before PD is backdated. You need not file July first. You can wait till Jul15 to see next VB and decide.

I was banking on that being FIFO so I could safely assume that my 485 wont be processed before the next retrogression kicks in in a couple of months -- giving me ample time to get married and bring my wife on H4!! :( :( And I do plan to get married in the next 6-9 months :(

May be its just me... but i think people like lou dobbs/Chris Simcox of Minute man defense corps/william gheen of Alipac (i think that's his name) thrive on misguiding and benefiting from innocent folks - I don't blame people who are misguided (who for the most part I would like to believe are genuinely concerned about illegal immigration). Its like the radio commercials... you want listeners to remember a phone #, keep repeating it... and the number sticks in your mind.
