From what I understand you can only and still will only be able to file I-485 when your PD is current. Now, if you belong to rest of the world EB2 the moment your labor clears your PD is current so you can file at the same time I-485 and I-140. In future you will have to delay the filing of I-485 for the three months that I-140 takes to clear (if your PD is current the moment the labor clears).

Is it okay to have an internal transfer (same company, from East Coast to West Coast) after obtaining the Green Card? Or transferring after 6 months to 1 year would be better?
If it's okay to transfer right away, does the new position need to have the same/similar title, duties, and salary?

Hello Gurus,
My I-140 was recently approved. 140-485 filed concurently in July 2007. I have a new job offer and plan to use AC21. However I am worried because the wages at new job would be significantly higher than the old job. There are two reasons for the big difference
1-Desi employer v/s corporate employer
2-Dallas v/s New York
Any comments from people who have faced similar situation will be highly appreciated.

I am planning to get my PP renewed at the NY consulate and had a couple of questions and I was hoping someone could shed some light on them.
i) The DC website states that one can *only* apply 6 months before expiration date but the NY website does not? Mine is going to expire in ~8 months. Anyone know if it is 6 mo across all consulates?

ii) They have it in big red font that the photograph should be 3.5 cm * 3.5 cm, the US standard PP size is 50 mm * 50 mm .. any ideas where I can get them done in the right dimension?
I did it at home - using my digital camera and photoshop :) . There are tons of places that would click the PP photographs!!
iii) If applied in person do they issue the PP the same evening?
You can't collect it that evening. The will fedex it to you within a week

i think paypal charges when the source funds are from credit card. ask his customers to pay thru their bank accounts to avoid that fee.

Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. A lot of times.. companies use this bugaboo of job desc etc.. Those that want to promote you badly enough will find a way.. First of all.. What your job title is v/s what labor is filed under is not directly related.. Secondly you can have matrix responsibilities that span across 2 bands etc.. So lot of times it's an excuse to not have to let you down hard way.. always easier to blame on that "damn immigration queue"

I am also trying to stay afloat through the very debatable AC21 process. Currently, my case is being handled by Ron Gotcher and I have been very happy with all the help and support so far. Not to mention, they are really reasonable.
Thanks for sharing. I don't think AC21 is very debatable as I have seen ppl used AC21 and currently holding GC without any unwanted issues.

And the 2007 was entered as a 2001, keep your fingers crossed and hope for the best.

Not an amended H1. It is an H1B extension for 3 years after I140.
The question is if you have this approval in your hand (whose start date is after your current visa validity) and you return to the country within your visa validity, will the official have I-94 valid till the end of the new approval or till the date your current visa is valid?
According to "Last Action" Rule of USCIS, there is a possibility that your H1B extention approval becomes invalid because the POE gave validity till your visa end.
Seems all so screwed up. But red-tape rules are never white and black.

If you submit the right documentation these days i-140 does not take more than an month.
