You are way more qualified than me. I only have 2 masters, research work, research papers. My attorney was able to get my EB1 approved without sponsorship. You will definitely get EB1

So if somebody does PhD in a core engineering or science and works as a post doctoral or full time researcher in national labs like Argonne and gets paid half of typical software salary (Even prestigious fellowships like Seyborg sometimes pay half of Bay area software salary) he does not contribute to the economy?

Thanks for your comment.I am afraid you mis understood what I said medicine and pharnact vet med etc. There are practitioners in these fields called MD, DVM, PHARM D etc. However there are many more PhD students who do research in these fields. And they are not listed as STEM graduates. I guess whoever did this listing of the STEM majors don't really have much knowledge about various fields of research and also they ignored the highly multidisciplanary nature of the current day research. I hope more people will start taking this issue seriously.

If your Attorney says it�s okay then probably you don�t have to worry.
However, your current Canadian address is not what you have in files on your I-485. Because, you can't give a foreign address.
So, I personally think you are beyond jeopardizing your pending I-485.

Is there any update on your case, I have similar situation,

applied a sublabor with a priority date july10,2001 for Eb3 ,which is current. Can i replace my old i140 with
the new i 140(eb3). and if i success fully do so, do I have still have to be with same employer for another 180 days.
When I called USCIS today they said some officer is reviewing my case, does this mean interfiling is automatic?
My PD is current for 2001 july10 eb3 category?

I'm providing updates here just for future reference for others -

Phew, that is a relief.
Oh, btw it turns out that the one officer responsible for handling this is on vacation, so I have call again after 2 weeks to schedule an appointment.

An IV core member is going to be helping you to fix this with USCIS. Let us know if you need help. He already tried contacting you yesterday.
As IV grows maybe this is a help IV can extend to all its donor members and help them if they get in such extreme distress situations. This is one of the ideas we are thinking for our members in the donor group.
Very good work by IV. I commend this effort in helping the people who are in such situations and hopefully this will lead to more people joining and willing to donate for the issues that affect us as a community

1. If I-140 is not yet approved and withdrawn, you lose I-485/AP/EAD.
2. I am not sure why they cannot file a second I-140 based on PERM LC right away. Seems to be a no-brainer to me. Must be one of those lawyer things :)

I wonder on what basis did they advance the dates by whatever margin they did. No doubt, any positive movement (in hours, days ) is good but the consolidated database is not in place as I understand and so this seems pretty much a watershed. The dates might move with out any GC being issued :)

What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?
Appreciate any responses ...
After you file 485 you are in AOS so you can file for AP and use that to get back into US. Once in AOS it doesn't matter if your H1B expired or I94 is expired as you will be in status. However to work you will need EAD.
To enter reenter US you should have a H1B visa stamp which is valid or have an AP. If you use your AP you will have to use EAD to continue working. Another option is to get a new H1B stamp based on your current H1B petition which is valid till april 2008.
