Hi guyz,
Bit of addtional information that might be just what was needed to make final call.
I spoke to Fragomen, my Law firm, and they informed me that priority date for filing I 45 (Green Card last stage) is current for Labor applications (EB3) filed in April 2001 and unless something dramatic happens again, things will move at its own pace.
My Labor (in EB3) was filed in March 2003. Estimated time to get GC might be anywhere between 1 year to ... who knows....
I am leaning towards resigning and start it fresh.. wherever...even If it is US fresh H1 will always be there.

I have some good news and some bad news!
The bad news is that. You will get your green card in 5 years and after other five years you will get your citizenship. So in 10 years will be in position to get married.

My EAD renewal application was once rejected saying 485 copy missing. I paper filed one more time . This time check is en cashed and also I received my receipt. But have not got the EAD card yet. My current EAD last date is 7/22/10. I am working on EAD . So what should i do to expedite my case.

Not sure if anyone experienced this, but on 2 computers this site, antivirus software detected a virus & my work PC (protected with McAfee) is not booting up, IT said my hard drive has been corrupted. My laptop survived with a freeware anti virus. Please don't give me reds, this is what happened to me, I just wanted to warn any unprotected members of IV.

Berkleybee isn't saying anything in that conversation with DOS which isn't already covered by the law or the note in 2005 visa bulletin.
Still; everyone is thinking it is a mistake and it is going to get current in 3 to 4months?
The cynic in me believes that everyone thinks it is just a matter of time before it becomes current or there is significant movements in dates. This is dead wrong. All one needs to do is look at data coming out from backlog processing centers; amount of 245i labors; statistics on how many people have come on h-1b; l-1's, b visas, f visas, amont of perm labor approvals; amount of greencards approved over the last five years.
It is going to be a very, very long time before there is significant movement in dates.
The cynic in me thinks Berkleybee posted it in immigration.com so that people may now get the message the dates aren't going to move. They aren't going to move significantly next year either. There is TOO many people going for greencards.
As long as people think that the dates are going to move, then they sit on the fence and don't do much to get rid of retrogression.
I am sure if people could get convinced that in current environment; visa dates will never get current then people may have some urgency in participating to get rid of retrogression.

Congratulations! :) I really hope that USCIS starts this proactive approach towards adjudicating applications, that way if and when our PD becomes current, the card production would be the only remaining step in this journey.

Some Background:
My employer filed for my residency in 2008. Per my employer, my PD is Jan 2008 and my I140 has been approved. My 6th year on H1B will be over in August 2011.
My questions to Attorney Reddy are as follows:
1. Can I switch employers now and retain my old PD?
2. Since I do not have a copy of the I140, would the employer be able to withdraw my I140 application?
3. Will I be able to get a 3 year extension on my H1B with the new employer based on my approved I140?
Please let me know. And many thanks to Ms. Reddy for providing this great service to the immigrant community :)

Though this can be the case but this is relief to those who have been stuck in NC for years ,so in that retrospect six months is far far better . I think many people can see the things to their interpretation , my take is that you never get everything right on the first time, u revisit and make changes and correct special situations that were not taken care of intially. It is a start atleast now we dont have poeple who are waiting in NC for years and asking about WOM.
Yes, agree and that is why I have already mentioned "improved" word in my first post. But clarity need to be established. I am giving USCIS a fair chance by using words "Doubt" and I have tried to research the subject but am not getting much authentic articles on net for the same. If somebody (Authentic article/lawyer/Sr. IV member) is saying that "Yes 6 months is from 485 receipt date".. Then I am fine otherwise it will be a missed oppertunity as we had a chance to have more clarified text from USCIS while it was writing a new memo w.r.t that law suite.
Why I opened this thread? Because I understand the seriousness of this process. After fighting out this, still we will be screwed on this interpretation then again we will be seeing million stuck in a queue (perhaps that may not be a NC queue but different queue.. for an example "processing" queue) And that will be a very darn serious situation...

if u have a valid H1, plus a valid stamp...empoyer may not give u 485 receipt as u can re-enter w/o prob. Just on H1
However, if ur H1 VISa stamp is expired..u have to either use AP (which was not filed, so cant use) or get VISa stamping fresh appt.

I took an info pass last week to check the status of my case. Specifically to check whether the interfile is success or not. IO at USCIS office mentioned that she cannot check whether my case is in EB2 or EB3. I am surprised to hear that. Gurus any has this kind of experience?
Also, She mentioned that my case is assigned to an Officer on August 13th. Do any one has any info how many days(on average), an Office will take to approve a case. Any info. is helpful to me and all.
Overall the Field Office people were polite.

Any idea of how many number of I-140s ? May be 50000+. It looks like it might take at least an year to process these I-140s in NSC/TSC. TSC is faster when compared to NSC, where the priority dates has not been moving, at least for EB1/EB3. What do you say ?
A trivial question: Do they process I-140s based on labor filed date (priority) or I-140 filed date ?
Hopefully they will reinstate PPS for I-140 after they are done with receipting the July/Aug applications.

Kondur, based on your signature, you have 3 active applications in the system. I understand EB1A, thats you sponsering yourself and no labor needed. EB2 with PD 02/08 is employer filed with PERM and I140 and whole nine yards. if I understand it right, EB2 NIW is also something an employer should sponser (or atleast help you with some documentation) and you file I-140 directly like EB1A. I know parallel applications are OK and EB2-NIW or EB1A are surely faster. but is there any reason behind that many applications at same time (other than increasing your probability of atleast one going thru?)..
