Yes. The malicious code did not download any virus or inject any virus in anyone's system. All it did was to redirect the user via a popup to a malicious website. Antivirus scanners pick this up as a virus alert, but it is not. It is more of an annoyance than a virus attack.
I honestly cannot vouch for the millions of hackers and script kiddies out there that this won't happen but use a good Anti-virus scanner especially if you have kids at home.

welcome to dphoto, people new to the D70 need to be aware of the focus area and how easy it is to be unlocked and moved accidently. I'm not saying you didn't have problems but I know others out there have done just what I had mentioned, including myself soon after purchasing the camera. Actually another user on this forum had focus problems and I had mentioned to him to check the focus area and he came back and said it was set wrong. I've yet to see any more posts from him to know if this completely fixed his back focus issues. I know that now I am aware of where and how to adjust and lock my focus area I've yet to have any problems in this department.

But back to topic - you will get hired for a paying job based on a combination of your talent, knowledge, and experience. Show them what you can do or have done. I've seen some amazing sites done by first-timers and some pretty crappy ones done by folk who have been flashing for awhile. Sites and site designers come in all flavors.

Latina: If you are correct then, since it is mentioned in so many posts that IV should achieve a non country quota, it should be clear for us (Rest of the World) category that this won't affect our waiting time; because if you are right that the Sernior voices were never advocating that the Worldwide Category will suffer any delays, it gets confusing after reading so many junior posters talking about not having a per country quota (just one line), that for newbies like me it is not crystal clear, of course I am all for the unused portion of the numbers for Worldwide category going to skilled immigrants from non worldwide rather than to anybody else.

You should take fulltime (permanent) position or atleast maintain one permanent position which is according to your LC.
This is the trick. If you feel that it will take a while before USCIS will adjudicate your case, you can take any job or not work at all but always be ready to show that you have a job offer as per LC once USCIS ask for it.
I have friend who was interviewed and was asked for a valid offer of employment as per LC. She's able to show it. But the thing is, her PD is far from being current.
This is the trick. If you feel that it will take a while before USCIS will adjudicate your case, you can take any job or not work at all but always be ready to show that you have a job offer as per LC once USCIS ask for it.

I am in a similar position and am going to wait till the end of the year for the AP. I am hoping to be able to go for the H1B stamping with the AP. So if there is any problem with the H1 I can atleast re-enter using the AP. Its a nice backup...
I know that if you don't have H1 stamping you need AP to reenter. But if you have AP why do you need H1 stamping if you are working for the same H1 employer after reentery? Is H1 stamping a backup to AP?

there is a gross misconception that iv is focusing "only" on 485 filing. and repeating is ad libidum is not helping.
the 485 measure is a short term tactical decision.it was taken after it became clear that nothing else could be added to an appropriation bill currently.remember that the attitude of the majority is to have a comprehensive bill ONLY.
certain members took to angrily denouncing the whole idea leading to a great deal of unpleasantness, of course the fault was on both sides as no tolerance for the opposing opinion was shown. it's sad though that some of these people now bad mouth iv on other forums.
as long as we insist on bickering and being divided, we will never succeed
let's just stop now, if that's all everyone wants to do on a daily basis. we can all stew in our own sweet juices for the next 20 years...WAITING.

The media caters to its audience just like any other business nterested in its own customers. When markets worldwide rise or fall in response to election results in India, it gets major media attention everywhere because the audience is interested. Diwali is as unimportant in America as Thanksgiving in the U.K. There is no point fretting over it. Diwali could become newsworthy when people globally start tracking shopping sales in India since their businesses might depend on them. It's better to sharpen our skills so that we can seamlessly join the global highway than to sit on the sides cursing those passing by that they don't care about us.

What if the job i'm moving to after 180 days is hiring me permanently now itself? Do they still have to specify (in EVL for AC21) that they will hire me perm only upon getting GC?
Just specify that they intend to employ you on a permanent basis. It does not really matter whether it happens before or after you get your GC.

Am expecting H1B approval 4/30/2007-4/30/2010 soon.
Plan to travel in February 2007.
One thing I noticed is my previous visa stamps only had a end date but no start date. So I am guessing/hoping the start date is effectively dictated by I797 (which I will have 2 of).

If you have a 3 year H1 extension (like I do now) you can get a stamping for 3 years and wont get tied up in AP extension filing etc. With the flood of applicants in July I think USCIS is going to take much longer to process AP/EAD and I am expecting periods between APs where I would be stuck, unable to travel. With a 3 year H1 stamp all those issues go away.
Traveling on AP also has the funny effect that your I-94 would be stamped to the expiry of the AP (1 year) rather than H1 (3 years) and I dont know what happens when that I-94 expires... H1 travel is simpler once you have a long lasting H1 stamp. Main advantage of AP is I can renew without leaving the country and if my I-485 ever gets approved when I am outside the country, I can re-enter (my H1 would be invalid at that point)

What is more legitimate that the other is something very subjective, and if you believe there even exist "legitimate" reasons, then you can always fall into the mistake of thinking that something minor, which you can easily overcome, is "legitimate" just because of your current state of mind and spirit.

My case is as detailed below, and my questions follow:
PD: July 2007, EB2 (India), Software field
Labor, I-140: Approved, I-485 etc. NOT filed.
H1 Petition and Visa valid until: Jan 2011 (after 7th year extension)
Currently outside US, NOT working for the H1 sponsoring employer.
My employer has NOT revoked my H1 or I-140.
I was working for the employer in US where the GC process started. Then moved to Canada in early 2008 when the PD was highly retrogressed/unavailable. Since then, worked in Canada in related field for a different (Canadian) employer. Things have been tough here: lower pay, very high taxes, friends all in US, and especially - the weather. We would like to return to US.
I will soon be able to apply for Canadian citizenship. I am in a dilemma now - whether to return to US on H1 NOW or to become a Canadian citizen and try my options LATER. I have the following questions:
(Same employer, as Indian citizen, knowing that I did not work for them for over 2 yrs, and was outside USA):
1) can I now(or anytime until Jan 2011 visa expiry) return to US to work for the same H1 sponsoring employer on the existing H1?
Yes...you can as long as your employer is also supporting you
2) would I be allowed the H1 extension in Jan 2011 based on approved I-140? Or is that doomed to be rejected because I was not working for the employer in between for over 2 yrs.
GC is for future employement and it should not affect. You are already out of the country for more than a year. So your 6 year limit is reset now.
3) Would the fact that I was out of US for 2 years help me get a "regular" extension?
I believe it should not have impact as the six year clock is reset and you also have I-140 approved
4) could I continue the GC after a gap of 2 yrs while I was not working for the employer?
Again, GC is for future employment.

I would say:
1. Stay on H1B as long as possible. Try not to use EAD unless absolutely necessary.
2. Because of 1 above, if you switch to the new employer USCIS would know you left the previous employer. (since you will file H1B transfer).
3. I see that you have everything worked out nicely from your current employer to have 180 days for your AC-21 portability. You have to really evaluate if it is really worth going to new employer in Dec 07. (if there is enormous financial gain like pre-IPO etc)
4. There is nothing wrong in switching jobs before 180 days either on EAD or H1B but in order to play safe the best bet is to, switch on H1B after 180 days. Enjoy your paid holidays and join the new employer in 2008 with peace of mind.

Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!

4. There is nothing wrong in switching jobs before 180 days either on EAD or H1B but in order to play safe the best bet is to, switch on H1B after 180 days. Enjoy your paid holidays and join the new employer in 2008 with peace of mind.

Here is my situation:
I-140 approved - PD: May '06
I-485 filed - July 30 '07 (India)
EAD cards - Received
APs - Received
Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!
